प्रयागराज | [कोर्ट बुलेटिन] | इलाहाबाद हाई कोर्ट ने कहा कि एससी/ एसटी एक्ट के अपराध की धारा-156 (3) की अर्जी पर मजिस्ट्रेट को कार्यवाही करने का अधिकार नहीं है। धारा-14 (1) के तहत विशेष अदालत को ही कार्यवाही करने का अधिकार है। कोर्ट ने यह भी कहा कि विशेष अदालत को भी नियम-5 (1) के तहत शिकायत को कंप्लेंट केस मानकर सुनवाई करने का अधिकार नहीं है।

 

एससी / एसटी एक्ट की विशेष अदालत को एफआईआर दर्ज करने की अर्जी पर पुलिस को विवेचना करने का निर्देश देने की बजाय परिवाद दर्ज कर कार्यवाही करने का अधिकार है या नहीं, इस बिंदु पर न्यायिक मतभिन्नता के मद्देनजर प्रकरण खंडपीठ को संदर्भित कर दिया है।

 

यह आदेश न्यायमूर्ति समित गोपाल ने नरेश कुमार बाल्मिकी की याचिका पर दिया है। कोर्ट ने मुख्य न्यायाधीश से मुद्दे पर कानूनी स्थिति स्पष्ट करने के लिए खंडपीठ नामित करने का आग्रह किया है। एकल पीठ ने विशेष अदालत के आदेश पर रोक लगाने से इनकार कर दिया है।

 

याची ने विशेष अदालत में सीआरपीसी की धारा 156(3) के तहत अर्जी देकर एफआईआर का निर्देश देने की मांग की। स्पेशल कोर्ट ने पुलिस को विवेचना का निर्देश देने की बजाय परिवाद दर्ज कर बयान के लिए सम्मन जारी किया है। इसकी वैधता को चुनौती दी गई है।

 

सरकारी वकील का कहना था कि विशेष अदालत को 156(3) की अर्जी पर पुलिस को निर्देश देने या प्रथमदृष्टया अपराध बनने की दशा में परिवाद दर्ज करने का अधिकार है। विशेष अदालत नियम पांच के तहत त्वरित न्याय के लिए कार्यवाही कर सकती है।

Whether the special court can file a complaint on the application of SC / ST FIR

 

Prayagraj | [Court Bulletin] | The Allahabad High Court said that the Magistrate has no right to act on the application of Section-156 (3) of the offense of SC / ST Act. Only the special court has the power to proceed under section 14(1). The court also said that the special court also does not have the right to hear the complaint as a complaint case under Rule-5 (1).

 

Instead of directing the Special Court of SC / ST Act to investigate the application for registration of FIR, instead of directing the police to take action by registering a complaint, the matter has been referred to the Division Bench in view of the judicial difference of opinion on whether or not.

 

Justice Samit Gopal has given this order on the petition of Naresh Kumar Balmiki. The Court has urged the Chief Justice to nominate a Bench to clarify the legal position on the issue. The single bench has refused to stay the order of the special court.

 

The petitioner filed an application under section 156(3) of CrPC in the special court and sought direction to the FIR. Instead of directing the police to investigate, the special court has issued summons for the statement by registering a complaint. Its validity has been challenged.

 

The public prosecutor said that the special court has the power to give directions to the police on the application of 156(3) or to register a complaint in case it becomes a prima facie offense. The Special Court can proceed for speedy justice under Rule 5.
