नई दिल्ली | [कोर्ट बुलेटिन] | ज्ञानवापी मस्जिद के मामले को वाराणसी जिला अदालत को सुप्रीम कोर्ट ने ट्रांसफर कर दिया है। सुप्रीम कोर्ट ने कहा कि ज्ञानवापी के मेंटेनेबिलिटी के मामले को प्राथमिकता से सुना जाना चाहिए और इसमें जिला जज सक्षम हैं, जो काफी अनुभवी हैं। सुप्रीम कोर्ट ने कहा कि इस मामले में फैसला जिला अदालत ही करेगी। मामले की सुनवाई के दौरान मुस्लिम पक्ष ने 1991 के Places of Worship Act ऐक्ट का भी जिक्र किया और कहा कि इसके तहत ज्ञानवापी के सर्वे का आदेश देना गलत था।

 

इस पर सुप्रीम कोर्ट ने इसी कानून के सेक्शन 3 का जिक्र किया और कहा कि सर्वे के आदेश में खामी नहीं थी।

 

जस्टिस चंद्रचूड़ बोले- धार्मिक स्थल का चरित्र तय करना भी हमारा काम

 

बेंच के सीनियर सदस्य जस्टिस डीवाई चंद्रचूड़ ने कहा कि धार्मिक स्थल का चरित्र तय करना भी हमारा कम है। 1991 के कानून का जिक्र करते हुए सुप्रीम कोर्ट ने कहा, ‘भूल जाइए कि वाराणसी में एक तरफ मस्जिद है और दूसरी तरफ मंदिर है। मान लीजिए कि पारसी मंदिर है और उसके एक कोने पर क्रॉस पाया जाता है। फिर क्या इसे क्रॉस अग्यारी कहा जाएगा या फिर अग्यारी क्रिश्चियन कहा जाएगा? हम इस हाइब्रिड कैरेक्ट से अनजान नहीं हैं।’

 

इस तरह ऐसी मिली-जुली चीजें पाए जाने पर एक पारसी पूजा स्थल क्रिश्चियन स्थान नहीं हो सकता और न ही ईसाई स्थान को पारसी मंदिर नहीं माना जा सकता। किसी भी स्थान का ऐसा हाइब्रिड कैरेक्टर हो तो फिर उसके निर्धारण के लिए जांच हो सकती है।

 

क्या अब 1991 का प्लेसेज ऑफ वर्शिप ऐक्ट नहीं होगा लागू?

 

सुप्रीम कोर्ट की इस टिप्पणी से साफ है कि 1991 का प्लेसेज ऑफ वर्शिप ऐक्ट इस मामले में रोड़ा नहीं अटकाता है। जानकारों का मानना है कि अदालत की टिप्पणी ने साफ कर दिया है कि ज्ञानवापी के मामले पर अब सुनवाई जारी रहेगी। सुप्रीम कोर्ट ने साफ कर दिया है कि इस पूरे मामले में फैसला निचली अदालत ही करेगी।

 

सुप्रीम कोर्ट ने सुनवाई के दौरान कोर्ट कमिश्नर की नियुक्ति को भी गलत नहीं माना। कोर्ट ने कहा कि कमिशन का गठन किया जा सकता है और वह अपनी रिपोर्ट दे सकती है। इसके साथ ही अदालत ने मुस्लिमों के लिए वजू की वैकल्पिक व्यवस्था करने, ‘शिवलिंग’ मिलने वाले स्थान की सील जारी रखने का भी आदेश बरकरार रखा। शीर्ष न्यायालय ने कहा कि यह आदेश अगले 8 सप्ताह यानी 17 जुलाई तक जारी रहेगा।

 

सुप्रीम कोर्ट ने भी माना जटिल है समस्या

 

सुप्रीम कोर्ट ने कहा कि ये जटिल सामाजिक समस्याएं हैं। इसमें मनुष्य द्वारा किया गया कोई भी समाधान सटीक नहीं हो सकता। हमारा आदेश इस बात पर था कि शांति व्यवस्था बनी रहे। यह काम अंतरिम आदेश से हो सकता है। हम देश की एकता के लिए एक संयुक्त मिशन पर हैं।

 

इसके अलावा रिपोर्ट लीक होने के सवाल पर सुप्रीम कोर्ट ने कहा कि एक बार यहां रिपोर्ट आ जाए तो फिर वह सेलेक्टिव तौर पर लीक नहीं हो सकती। इसके साथ ही बेंच ने हिदायत दी कि रिपोर्ट लीक नहीं होनी चाहिए। इसे सिर्फ जज ही खोल सकते हैं।

During the hearing of the case, the Muslim side also referred to the Places of Worship Act of 1991 and said that it was wrong to order the survey of Gyanvapi under it. On this, the Supreme Court referred to Section 3 of the same law and said that there was no flaw in the order of the survey.

 

 Justice Chandrachud said – It is our job to decide the character of the religious place

 

Justice DY Chandrachud, a senior member of the bench, said that it is also less for us to decide the character of the religious place. Referring to the 1991 Act, the Supreme Court said, “Forget that in Varanasi there is a mosque on one side and a temple on the other. Suppose there is a Parsi temple and a cross is found at one of its corners. Then will it be called Cross Agyari or will it be called Agyari Christian? We are not unaware of this hybrid character.

 

Thus, a Parsi place of worship cannot be considered a Christian place, and a Christian place cannot be considered a Zoroastrian temple if such a mix is ​​found. If any place has such a hybrid character, then it can be investigated for its determination.

 

 Will the Places of Worship Act of 1991 no longer apply?

 

It is clear from this observation of the Supreme Court that the Places of Worship Act of 1991 does not put an impediment in this matter. Experts believe that the court’s remarks have made it clear that the hearing on Gyanvapi’s case will now continue. The Supreme Court has made it clear that the lower court will decide in this entire matter.

 

The Supreme Court also did not consider the appointment of the Court Commissioner wrong during the hearing. The court said that the commission can be constituted and it can give its report. Along with this, the court also upheld the order to make alternative arrangements for Wazhu for Muslims, to continue the sealing of the place where ‘Shivling’ is found. The top court said that this order will continue for the next 8 weeks i.e. till July 17.

 

 The Supreme Court has also admitted that the problem is complex.

 

The Supreme Court said that these are complex social problems. In this any solution made by man cannot be accurate. Our order was that peace should be maintained. This work can be done by interim order. We are on a joint mission for the unity of the country.

 

Apart from this, on the question of leaking the report, the Supreme Court said that once the report comes here, then it cannot be leaked selectively. Along with this, the bench directed that the report should not be leaked. Only the judge can open it.
