नई दिल्ली | [कोर्ट बुलेटिन] | सुप्रीम कोर्ट ने सोशल एक्टिविस्ट तीस्ता सीतलवाड़ को गुजरात दंगा 2002 के मामले में बड़ी राहत देते हुए अंतरिम जमानत दे दी। तीस्ता सीतलवाड़ पर गवाहों के झूठे बयानों का मसौदा तैयार करने और उन्हें दंगों की जांच के लिए गठित नानावती आयोग के समक्ष प्रस्तुत करने का आरोप है। शीर्ष अदालत ने उनके देश छोड़ने पर रोक लगा दी है और उनसे कहा है कि वह जांच में पूरा सहयोग करें।

 

दरअसल, तीस्ता सीतलवाड़ ने सुप्रीम कोर्ट में अपील दायर कर सत्र अदालत और हाई कोर्ट के आदेश को चुनौती दी थी, जिसमें उन्हें अंतरिम जमानत नहीं दी गई थी। तीस्ता सीतलवाड़ की ओर से वरिष्ठ अधिवक्ता कपिल सिब्बल ने तर्क दिया कि उनके खिलाफ दर्ज प्राथमिकी 24 जून को सुप्रीम कोर्ट के फैसले के साथ समाप्त हुई कार्यवाही के अलावा और कुछ नहीं थी।

 

कपिल सिब्बल ने कहा कि तीस्ता सीतलवाड़ दो महीने से अधिक समय से हिरासत में हैं और उच्च न्यायालय के समक्ष लंबित मूल आवेदन के लंबित रहने के दौरान अंतरिम जमानत की हकदार हैं। तीस्ता सीतलवाड़ को अंतरिम जमानत देते हुए सुप्रीम कोर्ट ने उनसे जांच में पूरा सहयोग करने को कहा है।

 

सुप्रीम अदालत ने तीस्ता से अपना पासपोर्ट सरेंडर करने को कहा है। इसके अलावा सुप्रीम कोर्ट ने उच्च न्यायालय में लंबित तीस्ता की याचिका को लेकर कहा कि हमारे फैसले या टिप्पणी से उस पर कोई असर नहीं होना चाहिए। सुप्रीम कोर्ट ने कहा, ‘हमने यह फैसला सिर्फ अंतरिम बेल को लेकर दिया है। गुजरात हाई कोर्ट स्वतंत्र रूप से इस मामले पर विचार कर सकता है। सुप्रीम कोर्ट की टिप्पणियों से उसे प्रभावित नहीं होना चााहिए। बता दें कि गुजरात हाई कोर्ट ने 19 सितंबर को तीस्ता सीतलवाड़ की बेल अर्जी पर सुनवाई की तारीख तय की है।

 

 

 

Teesta Setalvad gets relief from Supreme Court, interim bail granted, orders for cooperation in investigation

 

New Delhi | [Court Bulletin] | The Supreme Court granted interim bail to social activist Teesta Setalvad in the 2002 Gujarat riots case. Teesta Setalvad is accused of drafting false statements of witnesses and presenting them before the Nanavati Commission set up to probe the riots. The top court has barred him from leaving the country and asked him to fully cooperate in the investigation.

 

In fact, Teesta Setalvad filed an appeal in the Supreme Court challenging the order of the Sessions Court and the High Court, in which interim bail was not granted to her. Senior advocate Kapil Sibal, appearing for Teesta Setalvad, argued that the FIR registered against him was nothing but the proceedings that ended with the Supreme Court’s decision on June 24.

 

Kapil Sibal said Teesta Setalvad is in custody for more than two months and is entitled to interim bail during the pendency of the original application pending before the High Court. While granting interim bail to Teesta Setalvad, the Supreme Court has asked her to fully cooperate in the investigation.

 

The Supreme Court has asked Teesta to surrender her passport. Apart from this, the Supreme Court said about Teesta’s petition pending in the High Court that our decision or comment should not affect it. The Supreme Court said, ‘We have given this decision only with regard to interim bail. The Gujarat High Court can consider the matter independently. He should not be influenced by the observations of the Supreme Court. The Gujarat High Court has fixed September 19 as the date for hearing on the bail application of Teesta Setalvad.
