राजद्रोह कानून (124 : ए—भारतीय दंड संहिता) के बखानने से राजग सरकार की सियासी किरकिरी तथा बौद्धिक फजीहत हो जाती। अपने परिष्कृत मंतव्य तथा विवेकाधारित कदम से बचाव करने में नरेन्द्र मोदी सरकार उच्चतम न्यायालय में मर्यादित हो गयी। छवि बिगड़ी नहीं। सलाखों के पीछे से सत्ता पर आने वाली राजग सरकार द्वारा नागरिक हकों का हनन अक्षम्य हो जाता। नेहरु—इंदिरा काबीनाओं द्वारा ऐसी जन—विरोधी कृतियां की जाती रहीं। एमर्जेंसी (1975—77) उसकी चरम बिन्दु थी। मोदी तब स्वयंसेवक थे। गुजरात में राजद्रोह के अपराधियों को जेल में राहत पहुंचाना उनके जिम्मे था। बड़ौदा सेन्ट्रल जेल के तन्हा कोठरी में मुझ पत्रकार को दैनिक अखबार पहुंचाने का काम इस स्वयंसेवक ने निभाया था। मछली को पानी की भांति, पत्रकार के लिए समाचारपत्र होते हैं। मुझ फांसी की सजा पाने वाले कैदी की यातना यह युवा जानता था।

 

तो फिर उनकी सरकार ने इस राजद्रोह कानून, जिसे बर्तानवी हुकूमत ने आजादी के दीवानों का दमन कराने हेतु रचा था, को क्यों लागू करना चाहा? बालगंगाधर तिलक तथा बापू (गांधीजी) इसके पहले शिकार थे। भारत रत्न डॉ बाबा साहे भीम राव अंबेडकर जी ने इसे संविधान की धारा (124—ए) बना दिया था।

 

इसी विषय पर अपना खेदजनक अचंभा व्यक्त करते हुये न्यायमूर्ति नूतलपाटि वेंकटरमण ने गत दिवस उच्चतम न्यायालय में पूछा भी था कि ऐसे अहितकारी काले कानून के औपनिवेशिक बोझ को आजादी के इस अमृत महोत्सव वर्ष में यह सरकार क्यों ढोना चाहती है? तेलुगुभाषी श्रमजीवी पत्रकार से प्रधान न्यायाधीश बना इस जज ने 1975 में आपातकाल का विरोध किया था तथा भूमिगत हो गया था। राजद्रोह के कानून पर वेंकटरमण बोले : ”एक बढ़ई को टहनी काटने हेतु आरा दिया गया, तो वह सरा जंगल ही काटने पर आमादा हो गया।” इस पर सरकारी वकील ने तत्काल बहस को स्थगन करने की याचना की। मोहलत मांगी बताया कि मोदी सरकार उत्तर में परिमार्जित प्रपत्र दाखिल करेगी।

 

मगर इतने से ही पर्याप्त भरपायी नहीं होगी। मोदी सरकार को तहकीकात करानी होगी कि राजग शासन कैसे ऐसे जनविरोधी, नृशंस कानून के पक्ष में चली गयी? आखिर यह सोनिया—कांग्रेस की सरकार तो नहीं है जो सास के आपातकाल का बचाव करे?  मोदी सरकार में करीब 1500 ब्रिटिश काले कानूनों का  गत वर्षों में खात्मा किया गया है। फिर यह 124 (ए) धारा क्यों बरकरार है? विधि मंत्री किरण रिजिजू, उनके विधि सलाहकार तथा आला अफसरों से जवाब—तलब किया जाये। विश्वपटल पर मोदी सरकार की लोकतांत्रिक ​छवि को साजिशन धूमिल किया गया है।

 

यहां मोदी सरकार के 90—वर्षीय महाधिवक्ता (एटार्नी जनरल) के.के.(कोट्टायम कातटनकोट) वेणुगोपाल पर भी सवालिया निशान लगते हैं। वे सुप्रीम कोर्ट का मंतव्य भांप गये थे कि इस संवैधानिक धारा के दुरुपयोग पर तीन जजवाली पीठ आशंकित हैं। फिर वेणुगोपाल क्यों जिरह कराते रहे? उन्होंने तो यहां तक कोर्ट में कह डाला था कि : ”केदारनाथ सिंह बनाम बिहार सरकार (पटना हाईकोर्ट 1962)” का निर्णय ही मान्य है। इस फैसले से धारा 124 (ए) द्वारा अभिव्यक्ति के आधार को संकुचित किया गया है। उसे प्रहार का औजार बनाया गया था। केदारनाथ सिंह बेगूसराय (बिहार) के फारवर्ड कम्युनिस्ट पार्टी के नेता थे जिन्होंने कांग्रेसी शासकों को जंमीदारों तथा सरमायेदारों का गुर्गा कहा था। इसी भांति 1954 में डा. राममनोहर लोहिया बनाम यूपी सरकार पर इलाहाबाद उच्च न्यायालय के फैसले को संपूर्णानन्द सरकार ने  सुप्रीम कोर्ट में चुनौती दी थी। डा. लोहिया को गुलाम भारत के विशेष अधिकार कानून 1932 के तहत कैद किया गया था। रिहा करना पड़ा। विशेष कानून अधिकार एक्ट को उच्च न्यायालय ने अवैध करार दिया था। इसके विरुद्ध अपील भी उच्चतम न्यायालय ने खारिज कर दी थी।

 

सत्ता के विरोध करने के इस जनवादी अधिकार की मांग के लोहिया वाले प्रकरण पर जिस पीठ ने निर्णय दिया उसमें प्रधान न्यायाधीश कोका सुब्बाराव, न्यायमूर्ति बीपी सिन्हा, न्यायमूर्ति जेसी शाह (दोनों बाद में प्रधान न्यायधीश हुए) तथा न्यायमूर्ति पीबी गजेंद्रगडकर थे। सभी ने लोहिया को मुक्त किया। इलाहाबाद हाईकोर्ट के निर्णय को स्वीकारा। इसीलिये ज्यादा ताज्जुब हुआ कि धारा 124 (ए) जिससे नागरिक स्वतंत्रता पर कुठाराघात होता रहा, उसकी सजग सरकार पक्षधर रही ?

Correction of Mistakes by Modi Government Part-I

 

The sedition law (124: A-Indian Penal Code) would have brought political disgrace to the NDA government and intellectual humiliation. The Narendra Modi government became limited in the Supreme Court in defending its sophisticated intentions and discretionary steps. The image did not deteriorate. Violation of civil rights by the NDA government that came to power from behind bars would have been unforgivable. Such anti-people works continued to be done by the Nehru-Indira cabinets. Emergency (1975–77) was its climax. Modi was a volunteer then. It was his responsibility to provide relief to the criminals of sedition in Gujarat in jail. This volunteer had done the work of delivering the daily newspaper to my journalist in a lonely cell of Baroda Central Jail. Newspapers are like water to a fish. This young man knew the torture of the prisoner who sentenced me to death.

 

Then why did his government want to implement this sedition law, which was created by the British government to suppress the freedom lovers? Bal Gangadhar Tilak and Bapu (Gandhiji) were its first victims. Bharat Ratna Dr. Babasaheb Bhim Rao Ambedkar ji made it Article (124-A) of the Constitution.

 

Expressing his regretful surprise on the same subject, Justice Nutalapati Venkataraman had also asked in the Supreme Court last day that why does this government want to carry the colonial burden of such harmful black laws in this nectar festival year of independence? Telugu speaking working journalist turned Chief Justice, this judge had opposed the Emergency in 1975 and went underground. On the law of sedition, Venkataraman said: “A carpenter was given a saw to cut a twig, then he was intent on cutting down the entire forest.” On this the public prosecutor immediately requested for adjournment of the debate. Asked for time, told that the Modi government will file the revised form in reply.

 

But that alone will not be sufficient compensation. The Modi government has to investigate how the NDA regime went in favor of such an anti-people, dastardly law. After all, isn’t it the Sonia-Congress government that defends the mother-in-law’s emergency? Around 1500 British black laws have been abolished in the last years under the Modi government. Then why is this 124(a) section intact? Answers should be summoned from Law Minister Kiren Rijiju, his legal advisor and top officials. The democratic image of the Modi government on the world stage has been deliberately tarnished.

 

Here the 90-year-old Advocate General (Attorney General) of the Modi government, KK (Kottayam Kattankot) Venugopal also faces question marks. They understood the intention of the Supreme Court that a three-judge bench is apprehensive of misuse of this constitutional clause. Then why did Venugopal continue to cross-examine? He had even said in the court that: The decision of “Kedarnath Singh Vs. Government of Bihar (Patna High Court 1962)” is valid. The judgment has narrowed the grounds of expression by section 124(a).

 

It was made a tool of attack. Kedarnath Singh was the leader of the Forward Communist Party of Begusarai (Bihar) who called the Congress rulers as henchmen of landlords and bourgeoisie. Similarly, in 1954, the decision of the Allahabad High Court on Dr. Ram Manohar Lohia Vs. UP Government was challenged by the Sampurnanand Sarkar in the Supreme Court. Dr. Lohia was imprisoned under the Indian Special Rights Act of 1932. had to be released. The Special Law Rights Act was declared illegal by the High Court. The appeal against it was also dismissed by the Supreme Court.

 

The bench which gave its decision on Lohia’s case demanding this democratic right to protest against power was Chief Justice Koka Subbarao, Justice BP Sinha, Justice JC Shah (both later became Chief Justice) and Justice PB Gajendragadkar. Everyone freed Lohia. Accepted the decision of Allahabad High Court. That is why it was more surprising that the vigilant government was in favor of Section 124 (A), which continued to attack civil liberties?
