मार्क्सवादी कम्युनिस्ट पार्टी द्वारा शासित केरल राज्य में अब कोई भी नयी मस्जिद निर्मित नहीं हो पायेगी। यह ममानियत अदालत (26 अगस्त 2022) ने लगायी है। सुदूर दक्षिण तटवर्ती क्षेत्र केरल में मुस्लिम आबादी 26.56 प्रतिशत है। हिन्दू 54.73 फीसदी तथा ईसाई 18.38 हैं। इस कोर्ट के फैसले की पृष्ठभूमि में एक आशंका यह रही कि सांप्रदायिक दंगे हो सकते है। अगर नये मंदिर-मस्जिद ज्यादा बनने की अनुमति दी जाये तो।
इसका संदर्भ है कि एक इस्लामी संस्था नुरूल इस्लाम संस्कारिक संगठन ने मुस्लिम-बहुल मल्लपुरम जनपद के नीलाम्बूर क्षेत्र में एक वाणिज्यी भवन को मस्जिद के रूप में अधिकृत कर दिये जाने की मांग की थी। याचिकाकर्ता ने कुरान की आयात का हवाला देकर अनुरोध किया है कि हर अकीदतमंद मुसलमान को मस्जिद सुगमता से उपलब्ध हो जाना चाहिये। इसे हाईकोर्ट ने खारिज कर दिया है।
कोर्ट ने राज्य के मुख्य सचिव को भी आदेश दिया है कि नये धर्म स्थलों के निर्माण की अनुमति देते समय संबंधित अधिकारी गंभीरता से विचार करें कि मौजूदा मस्जिद से नयी इमारत की दूरी कितनी होगी।
याचिका की सुनवाई के दौरान कारण भी गिनाये। केरल की उपलब्ध भूमि क्षेत्र के बारे में हाईकोर्ट के न्यायमूर्ति पीवी कुन्हिकृष्णन (बालकृष्ण) ने अपने आदेश (27 अगस्त 2022) में लिखा है कि प्रदेश में गांवों की कुल संख्या की तुलना में आस्था केन्द्र दस गुना ज्यादा है। वे अस्पतालों की संख्या के साढे़ तीन गुना अधिक है। इस प्रकार यदि मंदिर-मस्जिद ज्यादा बनते रहे तो एक दौर आयेगा जब जनता को आवास हेतु भूमि ही आवंटित नहीं हो पायेगी।
इस स्पष्ट आदेश में उच्च न्यायालय ने बताया कि बिल्कुल अत्यावश्यक परिस्थिति में ही नये निर्माण की इजाजत दी जाये। यह आदेश मुख्य सचिव को दिया गया है। न्यायमूर्ति ने यह भी लिखा कि कुरान मजीद में कोई भी सूरा अथवा पंक्ति नहीं है जो कहती है हर नुक्कड़ और मोड़ पर मस्जिद बनायी जाये।
इस पूरे प्रकरण के मूल में इस समस्या ने विकट रूप ले लिया है। अवैध निर्माण युग आये है केरल ईश्वर-अल्ला के आवरण में। ऐसे अवैध भवनों को तत्काल ध्वस्त किया जाये। उन्हें बंद करा दिया जाये।
सभी अवगत हैं कि सार्वजनिक स्थलों पर अतिक्रमण द्वारा धार्मिक निर्माण कराने की साजिश कोई नयी नहीं है। यहां उल्लेख अहमदाबाद का है। आजादी के तीन दशक पूर्व वाला। तब सरदार बल्लभभाई झवेरदास पटेल नगर महापालिका के अध्यक्ष थे। शहर यूं ही सकरा था। ऊपर से मंदिर बनवाकर राहगीरों के लिए चलने का स्थान ही मुश्किल से बचता था। सरदार पटेल जिनकी छवि हिन्दुवादी थी ने अतिक्रमित फुटपाथ पर निर्माण को ध्वस्त कराया। जो जैन मंदिर थे उन्हें भूमिगत बनवा दिया। पुजारी तथा भक्तजन सीढ़ी उतर कर दर्शन हेतु जाते थे।
यही सरदार पटेल थे जिन्होंने स्वतंत्रता के तुरंत बाद सोमनाथ मंदिर के भग्नावशेष से शिवालय पुर्नानिर्माण की विस्तृत योजना बनायी थी। उसकी निर्माण समिति के अध्यक्ष पद पर नवाब जूनागढ़ को नामित किया था। अवधारणा थी कि महमूद गजनी द्वारा (1026ई) में ध्वस्त किये गये देवालय का दायित्व उन्हीं के सहधर्मावलम्बियों पर डाला जाये। न्याय का यही तकाजा है। जवाहरलाल नेहरू ने सोमनाथ मंदिर के पुनर्निर्माण की तीव्र आलोचना की थी। उनकी राय में सेक्युलर भारत में सरकार को धार्मिक कार्यों से परहेज करना चाहिये।

Now no new mosque will be built in the state of Kerala ruled by the Communist Party of India-Marxist. This has been imposed by Mamaniyat Adalat (26 August 2022). The Muslim population in the far south coastal region of Kerala is 26.56 percent. Hindus are 54.73 percent and Christians are 18.38. In the background of this Court’s decision, there was an apprehension that there could be communal riots. If new temples-mosques are allowed to be built more then.
It is referenced that Nurul Islam Sanskar Sanskar Sangathan, an Islamic organization, had demanded that a commercial building in the Nilambur area of the Muslim-majority Mallapuram district be authorized as a mosque. The petitioner, citing the import of the Quran, has requested that the mosque should be easily available to every learned Muslim. This has been rejected by the High Court.
The court has also ordered the Chief Secretary of the state that while granting permission for the construction of new religious places, the concerned authorities should seriously consider the distance of the new building from the existing mosque.
Give reasons during the hearing of the petition. Regarding the available land area of Kerala, Justice PV Kunhikrishnan (Balakrishna) of the High Court has written in his order (27 August 2022) that the Aastha Kendra is ten times more than the total number of villages in the state. They are three and a half times more than the number of hospitals. In this way, if the temple-mosque continues to be built more, then a period will come when the land will not be allotted to the people for housing.
In this clear order, the High Court said that permission should be given for new construction only in absolutely urgent circumstances. This order has been given to the Chief Secretary. The Justice also noted that there is no surah or line in the Quran Majeed which says that a mosque should be built at every nook and corner.
At the core of this entire episode, this problem has taken a formidable form. Illegal construction era has come Kerala under the cover of God-Allah. Such illegal buildings should be demolished immediately. They should be closed.
Everyone is aware that the conspiracy to get religious construction done by encroachment on public places is not new. The mention here is of Ahmedabad. Three decades before independence. Then Sardar Vallabhbhai Jhaverdas Patel was the President of Nagar Mahapalika. The city was just like that. By building a temple from above, there was hardly any space left for the passers-by to walk. Sardar Patel, whose image was Hindu, demolished the construction on the encroached footpath. Those Jain temples were built underground. Priests and devotees used to descend the stairs and go for darshan.
It was Sardar Patel who made a detailed plan for the reconstruction of the pagoda from the ruins of the Somnath temple soon after independence. Nawab Junagadh was nominated as the chairman of its construction committee. The concept was that the responsibility of the temple demolished by Mahmud Ghazni in (1026 AD) should be put on his co-religionists. This is the demand of justice. Jawaharlal Nehru had strongly criticized the reconstruction of the Somnath temple. In his opinion, in a secular India, the government should abstain from religious activities.
