जबलपुर | [कोर्ट बुलेटिन] | मध्य प्रदेश लोक सेवा आयोग 19 जून से प्रारंभिक परीक्षा 2021 का आयोजन कर रहा है। मध्य प्रदेश हाईकोर्ट ने इसे स्थगित करने की मांग को अस्वीकार कर दिया है। याचिका भिंड के आकाश पाठक ने दायर की थी। उसका कहना था कि आयोग संवैधानिक नियमों की अवहेलना करते हुए तथा हाईकोर्ट के अंतरिम आदेश की अवमानना कर रही है।
याचिका में कहा गया था कि आयोग हाईकोर्ट के अंतरिम आदेश और नियमों का पालन नहीं कर रहा है। इस आधार पर प्रारंभिक परीक्षा 2021 को स्थगित किया जाए।
हाईकोर्ट के चीफ जस्टिस रवि विजयकुमार मलिमठ और जस्टिस अंजलि पालो की बेंच ने परीक्षा स्थगित करने की मांग अस्वीकार कर दी। साथ ही अनावेदकों को नोटिस जारी कर जवाब मांगा है।
हाईकोर्ट ने 7 अप्रैल 2022 में पारित आदेश में एमपीपीएससी 2019 की परीक्षा को असंवैधानिक घोषित किया था। एमपीपीएससी ने अभी तक साल 2019 की प्रारंभिक परीक्षा का संशोधित परिणाम जारी नहीं किया है।
2020 की प्रारंभिक परीक्षा में भी हाईकोर्ट के अंतरिम आदेश के बावजूद ओबीसी वर्ग को 27% आरक्षण दिया गया है। 2021 की प्रारंभिक परीक्षा के नोटिफिकेशन में ओबीसी को 31% आरक्षण दिया गया है। हाईकोर्ट ने ओबीसी वर्ग को सिर्फ 14% आरक्षण प्रदान करने के अंतरित आदेश जारी किए हैं।
Madhya Pradesh High Court refuses to postpone MPPSC Exams
Jabalpur | [Court Bulletin] | Madhya Pradesh Public Service Commission is conducting the Preliminary Examination 2021 from 19th June. The Madhya Pradesh High Court has rejected the demand for its adjournment. The petition was filed by Akash Pathak of Bhind. He said that the commission was violating the constitutional rules and contempt of the interim order of the High Court.
It was said in the petition that the commission was not following the interim orders and rules of the High Court. On this basis the preliminary examination 2021 should be postponed.
A bench of High Court Chief Justice Ravi Vijaykumar Malimath and Justice Anjali Palo rejected the demand for postponement of the examination. Along with this, notices have been issued to the appellants and have sought their answers.
The High Court had declared the MPPSC 2019 examination unconstitutional in an order passed on 7 April 2022. MPPSC has not yet released the revised result of preliminary exam for the year 2019.
In the preliminary examination of 2020 also, despite the interim order of the High Court, 27% reservation has been given to OBC category. In the notification of the preliminary examination of 2021, 31% reservation has been given to OBC. The High Court has issued transferred orders to provide only 14% reservation to OBC category.
