प्रयागराज | [कोर्ट बुलेटिन] | एक विवाहित महिला अपने पति के प्रति काफी पजेसिव होती है। वह उसे किसी के साथ शेयर नहीं सकती। यह टिप्पणी करते हुए हाल ही में इलाहाबाद हाईकोर्ट ने निचली अदालत के आदेश के खिलाफ एक व्यक्ति की याचिका को खारिज करते हुए कही, जिसमें उसने खुद को आत्महत्या के लिए उकसाने के आरोप से बरी करने की मांग की थी। इस व्यक्ति की पत्नी ने कथित तौर पर इस वजह से आत्महत्या कर ली थी कि उसके पति ने उसे तलाक दिए बगैर तीसरी महिला से शादी कर ली थी।
जस्टिस राहुल चतुर्वेदी की पीठ ने उसकी रिवीजन याचिका को खारिज कर दिया कि भारतीय महिला किसी भी कीमत पर अपने पति को साझा नहीं कर सकती है। अदालत ने कहा कि किसी भी विवाहित महिला के लिए यह सबसे बड़ा झटका होगा कि उसका पति किसी अन्य महिला के साथ साझा किया जा रहा है अथवा वह किसी अन्य महिला के साथ शादी करने जा रहा है।
ऐसी स्थिति में उससे किसी तरह की समझदारी की उम्मीद नहीं की जा सकती। इस मामले में ऐसा ही हुआ जब महिला ने यह पता चलने के बाद आत्महत्या कर ली कि उसके पति ने किसी अन्य महिला के साथ गुपचुप शादी कर ली है।
क्या था मामला
आरोपी सुशील कुमार की पत्नी ने सितम्बर 2018 में उसके और परिवार के सभी सदस्यों के खिलाफ आईपीसी की धारा 323, 494, 504, 506, 379 के तहत एफआईआर दर्ज कराई थी। महिला ने आरोप लगाया था कि आरोपी पहले से ही किसी अन्य महिला के साथ शादीशुदा था। उस शादी से उसके 2 बच्चे हैं।
इसके बाद उसने तलाक दिए बगैर तीसरी शादी कर ली है। महिला ने आरोपी और उसके परिवार के सदस्यों पर मारपीट, दुर्व्यवहार और गाली-गलौच करने का भी आरोप लगाया। आरोपी ने जब उसे छोड़ दिया और एक नई महिला को अपने घर में रख लिया तो महिला ने एफआईआर दर्ज करवाने का फैसला लिया और उसके तुरंत बाद जहरीला पदार्थ खाकर आत्महत्या कर ली।
आरोपी ने तीसरी शादी करना किया स्वीकार
हाईकोर्ट ने कहा कि आरोपी ने स्वीकार किया है कि उसने सितम्बर 2018 में तीसरी बार शादी की थी। कोर्ट ने माना कि महिला द्वारा आत्महत्या के फैसले के पीछे एकमात्र कारण पति का तीसरा विवाह ही है। इसके साथ ही हाईकोर्ट ने आरोपी की रिवीजन याचिका को खारिज कर दिया।

In September 2018, the wife of accused Sushil Kumar had lodged an FIR against him and all the family members under sections 323, 494, 504, 506, 379 of the IPC. The woman had alleged that the accused was already married with another woman. He has 2 children from that marriage.
After this she got married for the third time without giving divorce. The woman also accused the accused and his family members of assault, misbehavior and abusing her. When the accused left her and kept a new woman in his house, the woman decided to register an FIR and soon thereafter committed suicide by consuming poisonous substance.

The High Court said that the accused has admitted that he had married for the third time in September 2018. The court held that the husband’s third marriage was the sole reason behind the woman’s decision to commit suicide. Simultaneously, the High Court dismissed the revision petition of the accused.
