कानपुर | [कोर्ट बुलेटिन] | नाबालिग बेटी से रेप की रिपोर्ट लिखाने वाला पिता कोर्ट में मुकर गया। अदालत में खुद पीड़िता ने भी गवाही बदल दी पर, कोर्ट ने आरोपित को नाबालिग से बलात्कार के जुर्म में 7 साल की कैद की सजा सुना दी। कोर्ट ने 4500 रुपए अर्थदंड भी दिया है।
कोर्ट ने माना कि संबंध बनाते समय पीड़िता नाबालिग थी, इसलिए उसकी सहमति का कोई महत्व नहीं है। पीड़िता जो अब आरोपित की पत्नी है, सजा के बाद डेढ़ साल का बेटा गोद में लेकर फूट-फूट-कर रोती रही।
विशेष लोक अभियोजक पॉक्सो भावना गुप्ता ने बताया कि 25 जून 2018 को बिठूर थाने में दर्ज कराई गई रिपोर्ट में पीड़िता के पिता ने कहा कि 15 साल की बेटी सहजौरा गांव बारात में जा रही थी। वहीं से गायब हो गई। उसने चौबेपुर कलां निवासी संजय सोनी उर्फ अमित के खिलाफ बहला-फुसलाकर भगा ले जाने और पाक्सो का मुकदमा दर्ज कराया था। पुलिस ने संजय को गिरफ्तार कर जेल भेज दिया। उसके खिलाफ चार्जशीट भी लगाई थी। कोर्ट के समक्ष रिपोर्ट दर्ज कराने वाले पिता और दुष्कर्म पीड़िता दोनों ही पक्षद्रोही होकर मुकर गए।
पीड़िता ने गवाही में कहा कि वह अपनी मर्जी से संजय के साथ गई और संबंध भी बनाए थे। मंदिर में शादी भी की। अब उनका एक बेटा भी है, इसलिए पति को छोड़ दिया जाए। पिता भी मुकर गया लेकिन कोर्ट ने माना कि नाबालिग की सहमति का कोई महत्व नहीं है।
कोर्ट के सजा सुनाते ही जमानत पर चल रहे संजय सोनी उर्फ अमित को हिरासत में लेकर जेल भेज दिया गया। परिजनों ने बताया कि गिरफ्तारी के डेढ़ साल बाद संजय जमानत पर रिहा होकर आया था। उसके बाद उसने पीड़िता से शादी कर ली और दोनों पति-पत्नी की तरह रह रहे थे।

Special Public Prosecutor Poxo Bhawna Gupta said that in the report lodged at the Bithur police station on June 25, 2018, the victim’s father said that the 15-year-old daughter was going to Sahajaura village procession. From there it disappeared. He had filed a case of abduction and POCSO against Sanjay Soni alias Amit, resident of Chaubepur Kalan. The police arrested Sanjay and sent him to jail. A charge sheet was also filed against him. Both the father and the rape victim, who filed the report before the court, turned hostile.
The victim said in the testimony that she went with Sanjay of her own free will and also had a relationship. Got married in the temple. Now they also have a son, so the husband should be left. The father also retracted but the court held that the consent of the minor was of no importance.
Sanjay Soni alias Amit, who was out on bail, was sent to jail after the court pronounced the sentence. Relatives told that after a year and a half of his arrest, Sanjay had come out on bail. After that he married the victim and both were living as husband and wife.
