नई दिल्ली | [कोर्ट बुलेटिन] | राष्ट्रीय राजधानी दिल्ली में सड़कों के किनारे और कई जगहों पर बीच में अवैध तरीके से बड़े पैमाने पर धार्मिक ढांचा बनाए जाने पर उच्च न्यायालय ने मंगलवार को चिंता व्यक्त की है। न्यायालय ने सरकार और संबंधित प्राधिकार से कहा कि ऐसे ढांचों के खिलाफ कठोर कदम उठाने होंगे।
कार्यवाहक मुख्य न्यायाधीश विपिन सांघी और न्यायमूर्ति नवीन चावला की खंडपीठ ने सरकार से कहा कि यह गंभीर चिंता का विषय है। पीठ ने कहा कि यदि सड़कों के बीच में इस तरह से अवैध तरीके से चीजें आ रही हैं, तो सभ्य समाज कैसे बचेगा? पीठ ने कहा कि आपको (सरकार) एक संदेश देना होगा और स्पष्ट कड़ा संदेश देना होगा कि इस तरह की चीजों (सड़कों पर अवैध निर्मित धार्मिक ढांचों) को बर्दाश्त नहीं किया जाएगा। इसमें अतिक्रमण करने वालों के खिलाफ कड़ी कार्रवाई का संदेश होगा।
पीठ ने यह टिप्पणी राजधानी की सड़कों पर अवैध धार्मिक ढांचों के खिलाफ कार्रवाई की मांग को लेकर दाखिल याचिका पर सुनवाई के दौरान की है। यह याचिका अधिवक्ता एस.डी. विमलेश की ओर से दाखिल की गई है। उन्होंने उत्तर-पूर्वी दिल्ली के भजनपुरा इलाके में सड़कों के बीच में अतिक्रमण और धार्मिक संरचनाओं के खिलाफ कार्रवाई की मांग की है।
याचिका में कहा गया है कि इस तरह के अतिक्रमण से यातायात बाधित होता है और लोगों को परेशानियां होती हैं। पीठ ने कहा कि ‘हम यह समझ नहीं पा रहे हैं कि इस तरह के मसलों पर राज्य (सरकार) कैसे मूक दर्शक बन सकता है। पीठ ने कहा है कि हमारे विचार से, राज्य को ऐसे मामलों में एक स्पष्ट, निश्चित और दृढ़ रुख अपनाना चाहिए और अतिक्रमण करने वालों को संदेश देने के लिए कड़ा रुख अपनाना चाहिए कि इस तरह के अतिक्रमण को बर्दाश्त नहीं किया जाएगा।
सरकार को सख्त संदेश देना होगा
पीठ ने कहा कि सरकार को यह संदेश देना होगा कि जैसे ही कोई भी इस तरह का अतिक्रमण करेगा और इस तरह के ढांचे खड़ा करेगा, उनके खिलाफ दंडात्मक कार्रवाई की जाएगी। न्यायालय ने सड़कों से अवैध धार्मिक ढांचे को हटाने की मांग को लेकर दिल्ली सरकार, नगर निगम सहित सभी पक्षकारों को नोटिस जारी कर जवाब मांगा है। मामले की अगली सुनवाई 16 नवंबर को होगी।
Government should show strictness, order of Delhi High Court regarding illegal religious structures
New Delhi | [Court Bulletin] | The High Court on Tuesday expressed concern over the illegal construction of large-scale religious structures along the roads and in the middle of several places in the national capital. The court asked the government and the concerned authority to take stern action against such structures.
A division bench of Acting Chief Justice Vipin Sanghi and Justice Navin Chawla told the government that it was a matter of grave concern. The bench said that if such illegal things are coming in the middle of the roads, then how will the civilized society survive? The bench said that you (government) have to give a message and a clear and strong message that such things (religious structures built illegally on the roads) will not be tolerated. It will have a message of strict action against the violators.
The bench made the remarks during the hearing of a petition seeking action against illegal religious structures on the streets of the capital. This petition was filed by advocate S.D. Filed by Vimlesh. He has demanded action against encroachment and religious structures in the middle of the roads in Bhajanpura area of North-East Delhi.
It has been said in the petition that such encroachments cause traffic jam and inconvenience to the people. The bench said, “We are unable to understand how the state (government) can become a mute spectator on such issues.” The bench said that in our view, the State should take a clear, definite and firm stand in such matters and take a firm stand to send a message to the encroachers that such encroachment will not be tolerated.
The government has to give a strong message
The bench said the government has to send a message that as soon as anyone commits such encroachment and erects such structures, punitive action will be taken against them. The court has issued a notice to all the parties including the Delhi government, the municipal corporation and sought their response on the demand to remove the illegal religious structure from the roads. The next hearing of the case will be on November 16.
