नई दिल्ली | [कोर्ट बुलेटिन] | सुप्रीम कोर्ट ने लापरवाही बरतने के कारण हुई मौत के मामले में 2 लोगों की दोषसिद्धि को निरस्त करते हुए यह कहा कि पूरी तरह से अतार्किक लगता है कि टेलीफोन के एक तार से 11 केवी बिजली प्रवाहित हुई और इसके संपर्क में आने पर तार पिघला तक नहीं। मंगलवार को सुनवाई के दौरान अदालत ने कहा कि परिस्थितिजन्य साक्ष्य के मामले में जल्दबाजी में निष्कर्षों पर पहुंचने का खतरा होता है।

 

मुख्य न्यायाधीश एनवी रमना की अध्यक्षता वाली पीठ ने कर्नाटक हाईकोर्ट के फरवरी 2017 के फैसले के खिलाफ दोनों याचिकाकर्ताओं की अपील को स्वीकार कर लिया। हाई कोर्ट ने निचली अदालत के उस फैसले की पुष्टि की थी, जिसमें दोनों याचिकाकर्ताओं को दोषी करार दिया गया था और एक साल तथा 3 महीने की सजा सुनाई गई थी। यह घटना नवंबर 2003 में हुई थी, जब अपने घर में टेलीविजन देख रहे एक व्यक्ति ने टीवी पर अचानक एक आवाज सुनी।

 

खंभे पर काम करते समय टेलीफोन का तार खींच दिया

 

जब वह आपस में जुड़े तारों को छुड़ाने के लिए उठा, तब उसे बिजली का झटका लगा और करंट लगने से उसकी मौत हो गई। जांच के दौरान यह पाया गया है कि एक याचिकाकर्ता, जो टेलीफोन विभाग के एक कर्मचारी (दूसरे याचिकाकर्ता) की निगरानी में दिहाड़ी मजदूर के तौर पर काम करता है, ने खंभे पर काम करते समय टेलीफोन का तार खींच दिया।

 

क्या है आरोप?

 

बताया जाता है कि टेलीफोन का तार उखड़ गया और 11 केवी लाइन पर गिर गया। टेलीफोन के तार से होकर बिजली का प्रवाह हुआ जिसके चलते यह घटना हुई। यह आरोप है कि घटना याचिकाकर्ताओं के लापरवाही बरतने के चलते हुई।

A bench headed by Chief Justice NV Ramana allowed the appeal of both the petitioners against the February 2017 judgment of the Karnataka High Court. The High Court had upheld the lower court’s decision in which both the petitioners were found guilty and sentenced to one year and three months’ imprisonment. The incident happened in November 2003, when a man watching television at his home suddenly heard a sound on the TV.

 

 Telephone wire pulled while working on pole

 

When he got up to unplug the wires, he suffered an electric shock and died of electrocution. During investigation it has been found that one of the petitioners, who works as a daily wage laborer under the supervision of an employee of the Telephone Department (another petitioner), pulled the telephone wire while working on the pole.

 

 What is the charge?

 

It is said that the telephone wire got uprooted and fell on the 11 KV line. Electricity flowed through the telephone wire, due to which the incident took place. It is alleged that the incident took place due to negligence of the petitioners.
