नई दिल्ली | [नेशनल बुलेटिन] | सुप्रीम कोर्ट ने राजीव गांधी हत्याकांड मामले में दोषी ए.जी. पेरारीवलन को रिहा करने का बुधवार को आदेश दिया जो उम्रकैद की सजा के तहत 30 साल से अधिक समय से जेल में बंद है। न्यायमूर्ति एल. नागेश्वर राव की अध्यक्षता वाली एक पीठ ने अनुच्छेद 142 के तहत अपने विशेषाधिकार का इस्तेमाल करते हुए पेरारीवलन को रिहा करने का आदेश दिया। पीठ ने कहा, ” राज्य मंत्रिमंडल ने प्रासंगिक विचार-विमर्श के आधार पर अपना फैसला किया था। अनुच्छेद 142 का इस्तेमाल करते हुए, दोषी को रिहा किया जाना उचित होगा।”

 

राजीव गांधी हत्याकांड में सुप्रीम कोर्ट द्वारा एजी पेरारीवलन की रिहाई के आदेश के कुछ घंटों बाद पेरारीवलन ने कहा कि उनका दृढ़ विश्वास है कि मृत्युदंड की कोई आवश्यकता नहीं है।आपको बता दें कि प्रारंभ में उन्हें चेन्नई की एक विशेष अदालत द्वारा मृत्युदंड दिया गया था जिसे बाद में आजीवन कारावास में बदल दिया गया था।

 

पेरारीवलन ने अपनी मां अर्पुथम्मल और रिश्तेदारों के साथ संवाददाताओं से कहा, “मेरा दृढ़ विश्वास है कि मृत्युदंड की कोई आवश्यकता नहीं है। सर्वोच्च न्यायालय के मुख्य न्यायाधीशों सहित कई न्यायाधीशों ने ऐसा कहा है और कई ऐसे उदाहरण हैं। हर कोई इंसान है।”

 

यह पूछे जाने पर कि रिहा होने के बाद उन्हें कैसा लगा और उनकी क्या योजनाएं थीं, एजी पेरारीवलन ने कहा, “मैं अभी बाहर आया हूं। कानूनी लड़ाई को 31 साल हो चुके हैं। मुझे थोड़ी सांस लेनी है। मुझे कुछ समय दें।”

 

संविधान का अनुच्छेद 142 सुप्रीम कोर्ट को विशेषाधिकार देता है, जिसके तहत संबंधित मामले में कोई अन्य कानून लागू ना होने तक उसका फैसला सर्वोपरि माना जाता है।

 

पूर्व प्रधानमंत्री राजीव गांधी के हत्यारे ए. जी. पेरारीवलन को न्यायालय ने यह देखते हुए नौ मार्च को जमानत दे दी थी कि सजा काटने और पैरोल के दौरान उसके आचरण को लेकर किसी तरह की शिकायत नहीं मिली। शीर्ष अदालत 47 वर्षीय पेरारीवलन की उस याचिका पर सुनाई कर रही थी, जिसमें उसने ‘मल्टी डिसिप्लिनरी मॉनिटरिंग एजेंसी’ (एमडीएमए) की जांच पूरी होने तक उम्रकैद की सजा निलंबित करने का अनुरोध किया था।

 

1991 में हुई थी राजीव गांधी की हत्या

 

तमिलनाडु के श्रीपेरुम्बदुर में 21 मई, 1991 को एक चुनावी रैली के दौरान एक महिला आत्मघाती हमलावर ने खुद को विस्फोट से उड़ा लिया था जिसमें राजीव गांधी मारे गए थे। महिला की पहचान धनु के तौर पर हुई थी। न्यायालय ने मई 1999 के अपने आदेश में चारों दोषियों पेरारीवलन, मुरुगन, संथन और नलिनी को मौत की सजा बरकरार रखी थी।

 

उम्रकैद में बदली थी मौत की सजा

 

शीर्ष अदालत ने 18 फरवरी 2014 को पेरारीवलन, संथन और मुरुगन की मौत की सजा को उम्रकैद में तब्दील कर दिया था। न्यायालय ने केंद्र सरकार द्वारा उनकी दया याचिकाओं के निपटारे में 11 साल की देरी के आधार पर फांसी की सजा को उम्रकैद में बदलने का निर्णय किया था।

Hours after the Supreme Court ordered the release of AG Perarivalan in the Rajiv Gandhi assassination case, Perarivalan said he firmly believed that there was no need for capital punishment. Let us tell you that initially he was given death sentence by a special court in Chennai Which was later commuted to life imprisonment.

 

Perarivalan, along with his mother Arputhammal and relatives, told reporters, “I firmly believe that there is no need for capital punishment. Many judges, including the Chief Justices of the Supreme Court, have said this and there are many such examples. Everyone is human.”

 

When asked how he felt after being released and what were his plans, AG Perarivalan said, “I have just come out. It’s been 31 years since the legal battle. I have to take a breath. Give me some time.”

 

Article 142 of the Constitution gives the Supreme Court the privilege, under which its decision is considered to be of paramount importance in the matter concerned till no other law is enforced.

 

Former Prime Minister Rajiv Gandhi’s assassin A. Yes. Perarivalan was granted bail by the court on March 9 after observing that no complaint was received regarding his conduct while serving sentence and parole. The top court was hearing 47-year-old Perarivalan’s plea seeking suspension of his life sentence till the completion of the investigation by the ‘Multi-Disciplinary Monitoring Agency’ (MDMA).

 

 Rajiv Gandhi was assassinated in 1991

 

Rajiv Gandhi was killed by a female suicide bomber who detonated herself during an election rally in Sriperumbudur, Tamil Nadu on May 21, 1991. The woman was identified as Dhanu. In its May 1999 order, the court had upheld the death sentence awarded to the four convicts, Perarivalan, Murugan, Santhan and Nalini.

 

 Death sentence was changed to life imprisonment

 

On February 18, 2014, the apex court commuted the death sentences of Perarivalan, Santhan and Murugan to life imprisonment. The court had decided to commute the death sentence to life imprisonment on the basis of the delay of 11 years in disposal of their mercy petitions by the central government.
