बिलासपुर | [कोर्ट बुलेटिन] | सहायक शिक्षकों की भर्ती प्रक्रिया पर लगी रोक छत्तीसगढ़ हाईकोर्ट ने शुक्रवार को हटा दी है। इस आदेश के साथ ही 2700 पदों पर सहायक शिक्षकों की भर्ती का रास्ता साफ हो गया है। चीफ जस्टिस अरूप कुमार गोस्वामी और जस्टिस गौतम चौरड़िया की डिवीजन बेंच ने सुनवाई करते हुए कहा कि संविधान की 5वीं अनुसूची के तहत राज्यपाल मूलभूत अधिकार को कम नहीं कर सकते हैं। कोर्ट ने स्थानीय को ही अवसर देने की अधिसूचना को असंवैधानिक मानते हुए निरस्त कर दिया है। अब छत्तीसगढ़ के किसी भी जिले का पात्र अभ्यर्थी कोरबा, सरगुजा व बस्तर में शिक्षक बन सकता है।

बता दें कि 17 जनवरी 2012 को राज्यपाल द्वारा एक अधिसूचना जारी की गई थी, जिसमें बस्तर और सरगुजा संभाग में स्थानीय निवासियों को ही तृतीय व चतुर्थ श्रेणी के पदों पर मौका देने संबंधी अधिसूचना जारी की गई थी। यह आदेश केवल 2 साल के लिए लागू किया गया था। बाद में इसे बढ़ाकर 2023 तक कर दिया गया। यही नियम कोरबा जिले में भी लागू है।

राज्यपाल की इस अधिसूचना के खिलाफ शुशांत शेखर धराई और उमेश मिश्रा ने हाईकोर्ट में याचिका दायर की। राज्यपाल की अधिसूचना को चुनौती देते हुए न्यायालय को बताया कि प्रदेश के लोगों को जाति, जन्म व निवास के आधार पर नौकरी देने से वंचित नहीं किया जा सकता। सभी को समान अधिकार है। प्रदेश का व्यक्ति राज्य के किसी भी जिले में सरकारी नौकरी के लिए पात्र है।

मार्च-2019 में निकला था भर्ती का विज्ञापन

राज्य सरकार ने प्रदेश के सभी जिलों के साथ ही कोरबा जिला, सरगुजा व बस्तर संभाग में 19 मार्च 2019 को सहायक शिक्षकों की भर्ती के लिए विज्ञापन जारी किया था। पूरे राज्य के अभ्यर्थियों ने भाग लिया, लेकिन इन जगहों पर दूसरे जिलों के आवेदकों को भर्ती का मौका नहीं दिया गया। प्रारंभिक सुनवाई के दौरान डिवीजन बेंच ने पांचवीं अनुसूची में शामिल जिलों में सहायक शिक्षकों की भर्ती पर रोक लगा दी थी। जिस पर अब फैसला आया है।

पूरे प्रदेश के अभ्यर्थी कर सकेंगे आवेदन

हाईकोर्ट ने कहा है कि संविधान में सभी नागरिकों को समान रूप से रोजगार का अवसर दिया गया है। इसे पांचवीं अनुसूची के तहत हटाया नहीं जा सकता। डिवीजन बेंच ने कहा कि राज्यपाल और राज्य शासन को यह अधिकार नहीं है कि वह किसी भी जिले में स्थानीय निवासी को ही अवसर दें। विशेष परिस्थिति में आवश्यक होने पर अनुच्छेद 16 (3) के तहत निवास के आधार पर आरक्षण लागू करने का अधिकार सिर्फ संसद के पास है।

Assistant teacher will be recruited on 2700 posts, High Court lifts the ban

Bilaspur | [Court Bulletin] | The Chhattisgarh High Court on Friday lifted the ban on the recruitment process of assistant teachers. With this order, the way has been cleared for the recruitment of assistant teachers on 2700 posts. The Division Bench of Chief Justice Arup Kumar Goswami and Justice Gautam Chauradia, while hearing the hearing, said that the Governor cannot dilute the fundamental right under the 5th Schedule of the Constitution. The court has struck down the notification of giving opportunity to the local itself, considering it unconstitutional. Now eligible candidate of any district of Chhattisgarh can become a teacher in Korba, Surguja and Bastar.

Let us inform that on January 17, 2012, a notification was issued by the Governor, in which a notification was issued to give chance to the local residents in the third and fourth grade posts in Bastar and Surguja divisions. This order was implemented for only 2 years. Later it was extended till 2023. The same rule is applicable in Korba district also.

Shushant Shekhar Dharai and Umesh Mishra filed a petition in the High Court against this notification of the Governor. Challenging the notification of the Governor, told the court that the people of the state cannot be denied jobs on the basis of caste, birth and residence. Everyone has equal rights. The person of the state is eligible for government job in any district of the state.

Recruitment advertisement was out in March-2019

The state government had issued an advertisement for the recruitment of assistant teachers on March 19, 2019, in all the districts of the state as well as in Korba district, Surguja and Bastar divisions. Candidates from all over the state participated, but in these places applicants from other districts were not given the chance of recruitment. During the preliminary hearing, the Division Bench had stayed the recruitment of assistant teachers in the districts included in the Fifth Schedule. On which the decision has now come.

 Candidates from all over the state will be able to apply

The High Court has said that equal employment opportunity has been given to all citizens in the Constitution. It cannot be removed under the Fifth Schedule. The Division Bench said that the Governor and the State Government do not have the right to give opportunity to the local resident in any district. Only Parliament has the power to implement reservation on the basis of residence under Article 16(3) if necessary in special circumstances.
