नई दिल्ली | [कोर्ट बुलेटिन] | आय से अधिक संपत्ति के एक नए मामले में रिश्वतखोरी के आरोपों का सामना कर रहीं दिल्ली की अदालत की निलंबित जज रचना तिवारी लखनपाल और उनके पति के खिलाफ सीबीआई ने मामला दर्ज किया है। निलंबित जज रचना तिवारी पर कथित तौर पर 2.99 करोड़ रुपये की आय से अधिक संपत्ति अर्जित करने का आरोप है।

तीस हजारी कोर्ट में सीनियर सिविल जज के रूप में तैनात रहीं रचना तिवारी लखनपाल और उनके वकील पति आलोक को 2016 में एक अनुकूल निर्णय देने के लिए कथित तौर पर 4 लाख रुपये की रिश्वत लेने के आरोप में गिरफ्तार किया गया था। सीबीआई ने उस मामले में 2018 में चार्जशीट दाखिल की थी।

रिश्वत मामले की जांच करते हुए सीबीआई ने 2006-16 के दौरान दंपती द्वारा अर्जित कथित अवैध संपत्ति का पता लगाने का दावा किया।

एफआईआर में आरोप लगाया गया है कि जब रचना तिवारी लखनपाल न्यायिक सेवाओं में शामिल हुईं तब 27 जुलाई, 2006 को चेक अवधि की शुरुआत में इस दंपती के पास 1.09 लाख रुपये की संपत्ति थी, जो 28 सितंबर, 2016 को 10 वर्षों में 3.53 करोड़ रुपये से अधिक हो गई, जब उन्हें गिरफ्तार किया गया।

सीबीआई ने कहा है कि इस अवधि के दौरान दंपती की 1.05 करोड़ रुपये की आय हुई, जबकि उनका खर्च 51.73 लाख रुपये था।

सीबीआई की एफआईआर के अनुसार, दंपती ने 2.99 करोड़ रुपये की संपत्ति अर्जित की, जो कथित तौर पर उनकी आय के ज्ञात स्रोतों से अधिक है, जिसके लिए वे संतोषजनक स्पष्टीकरण नहीं दे सके।

एफआईआर में आरोप लगाया गया है कि इसके अलावा, यह उल्लेख करना प्रासंगिक है कि रचना तिवारी लखनपाल ने विभाग को 94.09 लाख रुपये की बेहिसाब नकदी के बारे में सूचित नहीं किया है जो घर की तलाशी से बरामद की गई थी और दिल्ली के न्यू राजेंद्र नगर के मकान संख्या R-546 के 1.60 करोड़ रुपये की राशि के वास्तविक मूल्य के बारे में भी छुपाया गया था।

आरोप है कि लाखों रुपये की बेहिसाबी नकदी है। ट्रैप के दिन रचना और आलोक लखनपाल के घर की तलाशी के दौरान 94.09 लाख रुपये बरामद हुए थे, जो उनके मास्टर बेडरूम की आलमारी में रखे गए थे।

एफआईआर में आरोप लगाया गया है कि जांच में पता चला कि रचना तिवारी ने एक हाथ में ब्रीफकेस (94,09,900 रुपये से युक्त) और नारंगी रंग का पैकेट (4 लाख रुपये की रिश्वत के पैसे से युक्त) लेकर इस राशि को 4 लाख रुपये की रिश्वत के साथ निपटाने का इरादा किया था।

इसके बाद सीबीआई टीम ने उन्हें गिरफ्तार कर लिया था। जांच के दौरान एजेंसी को एक सीसीटीवी फुटेज मिला, जिससे पता चला कि लखनपाल ने कथित तौर पर रकम को ठिकाने लगाने का भी प्रयास किया था।

सीबीआई ने आरोप लगाया कि रचना तिवारी लखनपाल पर संपत्ति एकत्र करने के लिए भ्रष्टाचार के नए आरोपों के तहत मामला दर्ज किया गया था, जबकि उनके पति आलोक उनके नाम और उनके रिश्तेदारों के संयुक्त नाम पर विभिन्न संपत्तियों के अधिग्रहण के लिए सक्रिय रूप से शामिल थे और वह भी उकसाने के लिए उत्तरदायी हैं।

Suspended judge Rachna Tiwari is accused of allegedly having disproportionate assets worth Rs 2.99 crore.

Rachna Tiwari Lakhanpal, who was posted as Senior Civil Judge in Tis Hazari Court, and her lawyer husband Alok were arrested in 2016 for allegedly accepting a bribe of Rs 4 lakh to deliver a favorable judgment. The CBI had filed a chargesheet in that case in 2018.

While probing the bribery case, the CBI claimed to have unearthed alleged illegal assets acquired by the couple during 2006-16.

The FIR alleges that the couple had assets worth Rs 1.09 lakh at the beginning of the check period on July 27, 2006, when Rachna Tiwari joined Lakhanpal judicial services, which increased to Rs 3.53 crore in 10 years as on September 28, 2016. more than that when he was arrested.

The CBI has said that the couple’s income during this period was Rs 1.05 crore, while their expenses were Rs 51.73 lakh.

According to the CBI FIR, the couple amassed assets worth Rs 2.99 crore, which is allegedly disproportionate to their known sources of income, for which they could not give a satisfactory explanation.

Further, it is pertinent to mention that Rachna Tiwari Lakhanpal has not informed the department about the unaccounted cash amounting to Rs 94.09 lakh which was recovered from the search of the house and found in New Rajendra Nagar, Delhi, the FIR alleged. The actual value of the house number R-546 of Rs.1.60 crore was also concealed.

It is alleged that there is unaccounted cash worth lakhs of rupees. During the search of Rachna and Alok Lakhanpal’s house on the day of the trap, Rs 94.09 lakh was recovered which was kept in the cupboard of their master bedroom.

It has been alleged in the FIR that investigation revealed that Rachna Tiwari, carrying a briefcase (containing Rs 94,09,900) and an orange colored packet (containing bribe money of Rs 4 lakh) in one hand, took this amount to Rs 4 lakh. had intended to settle with a bribe.

After this the CBI team arrested him. During investigation, the agency found a CCTV footage which revealed that Lakhanpal had allegedly tried to siphon off the money.

The CBI alleged that Rachna Tiwari Lakhanpal was booked under fresh charges of corruption to collect assets while her husband Alok was actively involved in the acquisition of various properties in her name and in the joint names of her relatives. And he is also liable to abetment.
