मुंबई | [कोर्ट बुलेटिन] | अपनी गर्लफ्रेंड का हाथ पकड़कर अपनी तरफ खींचना एक युवक को बहुत भारी पड़ गया। इस मामले को लेकर मुंबई की एक मजिस्ट्रेट कोर्ट ने युवक को सालभर कैद की सजा सुनाई है। मामला 8 साल पुराना है। अभी वह 2 साल के बेटे का बाप है। युवक का जुर्म यह है कि उसने अपनी गर्लफ्रेंड का हाथ पकड़कर अपनी तरफ खींचा था। इसे युवती की इज्जत से खिलवाड़ मानते हुए कोर्ट ने यह सजा सुनाई है। मामला 20 सितंबर 2014 का है।

युवक के वकील ने दलील थी कि अब उसकी शादी हो चुकी है और वह 2 साल के बेटे का बाप है। हालांकि कोर्ट ने इस दलील को स्वीकार नहीं किया।

हाई कोर्ट के फैसले का हवाला

कोर्ट ने कहा कि किसी का पूर्व प्रेमी होना इस बात की इजाजत नहीं देता कि उसके साथ कोई भी सुलूक किया जाए। टाइम्स ऑफ इंडिया के मुताबिक मेट्रोपॉलिटन मजिस्ट्रेट क्रांति एम पिंगले ने मामले की सुनवाई करते हुए युवक को प्रोबेशन ऑफ ऑफेंडर एक्ट के तहत अच्छे व्यवहार के आधार पर छोड़ने से भी मना कर दिया।

जज ने हाई कोर्ट के एक फैसले हवाला दिया, इस तरह का जुर्म करने वाले वाले को प्रोबेशन पर नहीं छोड़ा जाना चाहिए। वजह, मामला एक महिला की इज्जत से जुड़ा हुआ है। इसके मुताबिक युवक को इस तरह से छोड़ देने पर आगे इस तरह के जुर्म को बढ़ावा मिलेगा। साथ ही ऐसे तमाम अपराधों को रोकना या अपराधियों को पकड़ना भी मुश्किल हो जाएगा, जिससे महिलाओं के खिलाफ अन्य अपराधों को रोकना भी मुश्किल हो जाएगा।

युवक ने की थी नरमी की अपील

इस मामले में आरोपी महिला का पड़ोसी था। उसने इस आधार पर खुद को बरी किए जाने की अपील की थी कि घटना 2014 की है और इसे कई साल बीत चुके हैं। युवक का कहना है कि अब उसकी किसी अन्य महिला से शादी हो चुकी है और वह 2 साल के 1 बच्चे का बाप भी है। इस पर कोर्ट का कहना था कि युवक के मौजूदा हालात को देखते हुए उसकी सजा में कमी की जा सकती है लेकिन उसने जो जुर्म किया है, उसके लिए कुछ सजा तो देनी ही होगी।

युवक के ऊपर 5000 रुपए का फाइन भी लगाया गया है। इस मामले में युवती के साथ उसके पिता और चाचा भी गवाह थे। युवती का कहना है घटना 20 सितंबर 2014 में उसकी सीढ़ियों पर हुई थीं। मामले में एफआईआर दर्ज हुई थी। आरोपी युवक गिरफ्तार हुआ था और बाद में जमानत पर रिहा हो गया था।

 Referring to the decision of the High Court

The court said that being someone’s ex-lover does not allow for any treatment to be done with him. According to the Times of India, Metropolitan Magistrate Kranti M Pingle, while hearing the case, also refused to release the youth on the ground of good behavior under the Probation of Offender Act.

The judge cited a decision of the High Court, the person who committed such a crime should not be released on probation. The reason being, the matter is related to the honor of a woman. According to this, leaving the youth in this way will encourage further such crimes. At the same time, it will be difficult to stop all such crimes or catch the criminals, which will also make it difficult to stop other crimes against women.

 The young man had appealed for leniency

The accused in this case was the neighbor of the woman. He had appealed for his acquittal on the ground that the incident happened in 2014 and many years had passed. The young man says that now he is married to another woman and he is also the father of a 2-year-old child. On this, the court said that in view of the present situation of the youth, his sentence can be reduced, but for the crime he has committed, some punishment will have to be given.

A fine of Rs 5000 has also been imposed on the youth. Along with the girl, her father and uncle were also witnesses in this case. The girl says that the incident happened on her stairs on 20 September 2014. An FIR was registered in the matter. The accused youth was arrested and later released on bail.
