जबलपुर | [कोर्ट बुलेटिन] | OBC आरक्षण 13 फीसदी होल्ड किए जाने को चुनौती देते हुए मप्र हाईकोर्ट में शासन द्वारा याचिकाएं दायर की गई हैं। चीफ जस्टिस रविविजय मलिमथ व जस्टिस विशाल मिश्रा की युगलपीठ ने उक्त मामले में शासन को 6 सप्ताह में जवाब पेश करने के निर्देश दिए हैं।
एडवोकेटस वेलफेयर एसोसिएशन के अधिवक्ता ने बताया कि आरक्षण अधिनियम 1994 में किए गए संशोधन 14 अगस्त 2019, जिसमें OBC को 14 से बढ़ाकर 27 फीसदी आरक्षण की व्यवस्था की गई है। उक्त संशोधन के प्रवर्तन पर हाईकोर्ट द्वारा किसी भी प्रकार की रोक या स्टे आदेश जारी नहीं किया गया है।
उन्होंने बताया कि मध्य प्रदेश शासन की ओर से प्रकरणों में नियुक्त ओआईसी द्वारा 11 जून 2021 को एक आवेदन हाईकोर्ट में दाखिल करके OBC के 13 फीसदी आरक्षण को होल्ड करने का निवेदन किया गया, जिस पर हाईकोर्ट ने 13 जुलाई 2021 को शासन की सहमति से आदेश पारित करके शिक्षक भर्ती में OBC का 13 फीसदी होल्ड किया था।
जिसके बाद अक्टूबर 2021 में की गई शिक्षकों की नियुक्तियों में OBC के 16 विषयों में 13 फीसदी पदों को होल्ड कर दिया गया है, जिसके विरुद्ध सैकड़ों OBC के चयनित शिक्षकों ने OBC एडवोकेड्स वेलफेयर एसोसिएशन के अधिवक्ताओं के माध्यम हाईकोर्ट में अनेक याचिका याचिकाएं दायर की हैं।
उक्त याचिकाओं में से 2 याचिकाओं पर हुई सुनवाई के दौरान आवेदकों की ओर से तर्क दिए गए कि OBC के 27 फीसदी आरक्षण के प्रवर्तन पर हाईकोर्ट की कोई रोक नहीं है तथा उक्त आरक्षण की वैधानिकता को डिसाइड करने में न्यायालय को समय लग रहा है।
शासन पक्ष भी उक्त प्रकरणों पर हर मर्तबा समय ले रहा है। जिस पर न्यायालय द्वारा उक्त तर्कों से सहमत होते हुए याचिका को विचारार्थ स्वीकार करते हुए 6 सप्ताह के अंदर शासन से जवाब तलब किया गया है।
Challenge to hold OBC reservation 13 percent, High Court seeks answer from government
Jabalpur | [Court Bulletin] | Petitions have been filed by the government in the MP High Court challenging the OBC reservation holding 13 percent. A bench of Chief Justice Ravivijay Malimath and Justice Vishal Mishra has directed the government to submit its reply in 6 weeks in the said matter.
Advocates of Advocates Welfare Association said that the amendment made in the Reservation Act 1994 on 14 August 2019, in which the OBC has been increased from 14 to 27 percent reservation. No stay or stay order has been issued by the High Court on the enforcement of the said amendment.
He said that by filing an application in the High Court on June 11, 2021 by the OIC appointed in the cases on behalf of the Madhya Pradesh government, a request was made to hold the 13 percent reservation of OBCs, on which the High Court ordered on July 13, 2021 with the consent of the government. By passing, he had held 13 percent of OBCs in teacher recruitment.
After which 13 percent of the posts in 16 subjects of OBC have been held in the appointments of teachers made in October 2021, against which hundreds of selected teachers of OBC have filed many petitions in the High Court through the advocates of OBC Advocates Welfare Association. .
During the hearing on two of the petitions, it was argued on behalf of the applicants that there is no stay of the High Court on the enforcement of 27 per cent reservation for OBCs and the court is taking time to decide the legality of the said reservation.
The government side is also taking time on the above matters every time. On which, agreeing with the above arguments, the court has called for a reply from the government within 6 weeks, accepting the petition for consideration.
