भोपाल | [कोर्ट बुलेटिन] | ओबीसी आरक्षण को लेकर मध्य प्रदेश में सुनवाई एक बार फिर टल गई। 16 अगस्त को होने वाली सुनवाई 22 अगस्त 2022 को नियत कर दी गई है। OBC आरक्षण के पक्ष में चयनित शिक्षकों ने कुल 63 याचिका दायर की हैं। जिसकी आज सुनवाई होनी थी लेकिन डबल बेंच ना बैठने के कारण सुनवाई टाल दी गई है।

 

दरअसल 16 अगस्त को OBC आरक्षण को लेकर हाईकोर्ट में सुनवाई थी। जिसमें सरकार का पक्ष रखने के लिए सॉलिसिटर जनरल तुषार मेहता को हाईकोर्ट पहुंचना था, लेकिन तुषार मेहता हाईकोर्ट नहीं पहुंच पाएं। इससे पहले 25 जुलाई और 1 अगस्त को होने वाली सुनवाई में भी सॉलिसिटर जनरल हाईकोर्ट नहीं पहुंच पाए थे।

 

बता दें कि इस मामले को लेकर हाईकोर्ट में मध्य प्रदेश में अन्य पिछड़ा वर्ग, ओबीसी को 27 या 14 प्रतिशत आरक्षण देने के कानूनी पहलू पर पिछले तीन साल से बहस चल रही है। हाईकोर्ट में ओबीसी आरक्षण को लेकर कुल 63 याचिकाएं विचाराधीन हैं। कुछ याचिकाएं ओबीसी उम्मीदवारों की ओर से दायर की गई हैं।

 

साथ ही इसके कुछ याचिकाएं सामान्य उम्मीदवारों की ओर से दायर की गई हैं। जिनमें ओबीसी को 27 फीसदी आरक्षण का विरोध किया गया है। इनमें पीएससी, शिक्षक भर्ती, समेत कई विभागों की नियुक्तियों में कोर्ट ने अंतरिम आदेश के तहत ओबीसी को 14 फीसदी आरक्षण देने को कहा है।

 

इससे पहले एमपी सरकार ने हाईकोर्ट के निर्देश पर ओबीसी का डाटा पेश किया था। इससे पहले तत्कालीन कमलनाथ सरकार ने जनसंख्या का डेटा प्रस्तुत किया था। जिसके बाद शिवराज सरकार ने प्रतिनिधित्व का डेटा पेश किया। उक्त डेटा में कुल स्वीकृत पदो की संख्या 3,21,944 में से ओबीसी वर्ग को मात्र 43,978 पद अर्थात 13.66% आरक्षित बताया गया है। यह डेटा हाईकोर्ट में प्रस्तुत किए जा चुके हैं।

 

जानकारी के अनुसार एमपी में 1994 से पहली बार ओबीसी को 14 प्रतिशत आरक्षण दिया गया था। लेकिन तत्कालीन कमलनाथ ने कांग्रेस सरकार में इसे 27 प्रतिशत कर दिया था। और बादमे हाईकोर्ट में कई याचिकाएं लगाई गई। मध्य प्रदेश हाई कोर्ट में ओबीसी आरक्षण से संबंधित कई मामले विचाराधीन हैं।

A total of 63 petitions have been filed by the selected teachers in favor of OBC reservation. Which was to be heard today, but due to non-sitting of the double bench, the hearing has been postponed.

 

In fact, on August 16, there was a hearing in the High Court regarding OBC reservation. In which Solicitor General Tushar Mehta had to reach the High Court to represent the government, but Tushar Mehta could not reach the High Court. Earlier, the Solicitor General could not reach the High Court even in the hearings to be held on July 25 and August 1.

 

The legal aspect of giving 27 or 14 percent reservation to Other Backward Classes, OBCs in Madhya Pradesh is being debated in the High Court for the last three years. A total of 63 petitions are pending in the High Court regarding OBC reservation. Some petitions have been filed on behalf of OBC candidates.

 

Also some of its petitions have been filed on behalf of general candidates. In which 27 percent reservation for OBC has been opposed. In these, in the appointments of many departments including PSC, teacher recruitment, the court has asked to give 14 percent reservation to OBCs under the interim order.

 

Earlier, the MP government had presented the data of OBCs on the instructions of the High Court. Earlier, the then Kamal Nath government had presented the population data. After which the Shivraj government presented the data of representation. In the above data, out of the total sanctioned number of 3,21,944 posts, only 43,978 posts i.e. 13.66% have been reserved for OBC category. This data has been presented in the High Court.

 

According to the information, for the first time since 1994, 14 percent reservation was given to OBCs in MP. But the then Kamal Nath had reduced it to 27 percent in the Congress government. And later many petitions were filed in the High Court. Many cases related to OBC reservation are pending in the Madhya Pradesh High Court.
