पटना | [कोर्ट बुलेटिन] | जमालपुर- क्यूल रेलखंड के अभयपुर और कजरा रेलवे स्टेशनों के बीच लोकोपयोगी रेलवे की जमीन पर अवैध अतिक्रमण मामले में कड़े कदम उठाने के निर्देश पटना हाईकोर्ट ने दिया है। पटना हाईकोर्ट ने कहा है कि रेलवे तत्काल अवैध कब्जेधारियों को 25 जुलाई तक जमीन को खाली करवाएं। यदि तय समय में रेलवे की जमीन खाली नहीं की जाती तो पुलिस बल की सहायता से बलपूर्वक जमीन खाली कराये। और अतिक्रमण कर बने अवैध निर्माण को ध्वस्त किया जाय।
पटना हाईकोर्ट ने पुलिस अधिकारियों को रेलवे प्रशासन को कब्जा हटाने में पुलिस सहायता उपलब्ध कराने का भी आदेश दिया है। जिसके बाद पहले दिन आरपीएफ की टीम की अगुवाई में अभयपुर रेलवे स्टेशन पहुंच बुलडोजर से 70 से 80 मकानों के एक्सटेंशन पार्ट को ध्वस्त कराया।
दोषी अधिकारियों के खिलाफ भी लिया जाए एक्शन
पटना हाईकोर्ट ने अपने आदेश में साफ कहा है कि रेलवे की जमीन पर अवैध कब्जा करने वालों के खिलाफ सिविल व आपराधिक कार्यवाही भी की जाय। साथ ही रेलवे ,जिला प्रशासन व राज्य सरकार अवैध कब्जा करने देने वाले दोषी अधिकारियों व लोगों के खिलाफ कार्रवाई करने का भी निर्देश दिया है।
कोर्ट ने रेलवे को अपनी जमीन के सीमांकन की जांच कर रजिस्टर बनाने के लिए कहा। हिदायत दी कि देखें आगे अतिक्रमण नहीं होने पाए।
जानकारी के अनुसार रेलवे का इंजीनियरिंग विभाग इन दोनों रेलवे स्टेशनों के बीच रेलवे की जमीन पर से अतिक्रमण हटाने को लेकर रेलवे से जुड़ी सुरक्षा एजेंसियों को कई बार पत्राचार कर अतिक्रमण हटवाने की मांग रही थी। परंतु मामले में किसी भी प्रकार की कोई सुनवाई नहीं होने के बाद मामला आखिरकार पटना हाईकोर्ट पहुंच गया।
जहां याची का कहना था कि रेलवे की जमीन पर अवैध कब्जा कर लिया गया है। अधिकारी उन्हें बेदखल नहीं कर रहे हैं। जिसके कारण विकास बाधित होगा और जनता को बेहतर सुविधाएं मुहैया कराने में काफी मुश्किलें आ रही है। जिसके बाद हाईकोर्ट ने अतिक्रमण हटाने के फैसलों पर विचार करने के बाद सख्त आदेश जारी किया।
आरपीएफ इंस्पेक्टर ने बताया कि हाईकोर्ट के आदेश के बाद अभयपुर कजरा रेलवे स्टेशन के बीच रेलवे की जमीन पर अनाधिकृत रूप से बने मकानों को हटाने की प्रक्रिया आरंभ कर दी गई है। पहले दिन 70-80 मकानों के एक्सटेंशन पार्ट पर बुलडोजर चलवा ध्वस्त किया गया है। अभियान अभी जारी रहेगा। आगामी 27 जुलाई तक पूरे क्षेत्र को अतिक्रमणमुक्त कर दिया जाएगा।
Bulldozers run on the orders of the High Court on the houses of illegal occupants on railway land
Patna | [Court Bulletin] | Patna High Court has directed to take strict steps in the case of illegal encroachment on public utility railway land between Abhaypur and Kajra railway stations of Jamalpur-Kiul railway section. Patna High Court has said that the railways should immediately get the illegal occupants vacated the land by July 25. If the railway land is not vacated within the stipulated time, then the land should be vacated by force with the help of police force. And the illegal construction made by encroachment should be demolished.
The Patna High Court has also ordered the police officers to provide police assistance to the railway administration in removing the encroachments. After which on the first day, under the leadership of the RPF team, the extension part of 70 to 80 houses was demolished by bulldozer reaching Abhaypur railway station.
Action should also be taken against the guilty officers
Patna High Court has clearly said in its order that civil and criminal action should also be taken against those who illegally occupy railway land. Along with this, railways, district administration and state government have also been directed to take action against the guilty officers and people who allowed illegal occupation.
The court asked the railways to examine the demarcation of its land and prepare a register. Instructed that there should be no further encroachment.
According to the information, the Engineering Department of the Railways had been demanding the removal of the encroachment by correspondence several times to the security agencies related to the railways, regarding the removal of encroachments from the railway land between these two railway stations. But after no hearing in the matter, the matter finally reached the Patna High Court.
Where the petitioner said that the railway land has been illegally occupied. The authorities are not evicting them. Due to which development will be hampered and there is a lot of difficulty in providing better facilities to the people. After which the High Court, after considering the decisions to remove the encroachment, issued a strict order.
RPF Inspector said that after the order of the High Court, the process of removing unauthorized houses built on railway land between Abhaypur Kajra railway station has been started. On the first day, the bulldozer has been demolished on the extension part of 70-80 houses. The campaign will still continue. By July 27, the entire area will be encroachment-free.
