वंदे मातरम् को मिले राष्ट्रगान के बराबर सम्मान, याचिका दायर vande maataram ko mile raashtragaan ke baraabar sammaan, yaachika daayar
नई दिल्ली | [कोर्ट बुलेटिन] | हाई कोर्ट दिल्ली में एक PIL (जनहित याचिका) फाइल करके मांग की गई है कि राष्ट्र गीत ‘वंदे मातरम्’ को राष्ट्र गान ‘जन गण मन’ के बराबर सम्मान दिया जाए। याचिका में कहा गया है कि स्वतंत्रता आंदोलन के दौरान यह गीत खूब गाया जाता था। कोर्ट से मांग की गई है कि वह केंद्र सरकार को निर्देश दे की स्कूलों और अन्य शिक्षण संस्थानों में रोज राष्ट्रगान के साथ ‘वंदे मातरम’ भी गाया या बजाया जाए। वकील अश्विनी उपाध्याय ने यह याचिका दायर की है।
याचिका में यह भी मांग की गई है कि 24 जनवरी 1950 को मद्रास कोर्ट और सुप्रीम कोर्ट द्वारा दिए गए फैसले का पालन किया जाए। याचिका में अश्विनी ने कहा कि सभी भारतीयों का कर्तव्य है कि वे वंदे मातरम गाएं और देश की अखंडता को बनाए रखें। इसके अलावा सरकार का भी यह दायित्व है कि वह जन गण मन और वंदे मातरम को समान रूप से प्रमोट करें।
उन्होंने कहा कि वंदे मातरम से किसी की भावनाएं आहत होने का सवाल नहीं है क्योंकि संविधान निर्माताओ ने इसे सम्मान देने की बात कही थी। याचिका में कहा गया, ‘जन गण मन में एक राष्ट्र को ध्यान में रखते हुए भावनाएं व्यक्त की गई हैं वहीं वंदे मातरम में देश के चरित्र की बात की गई है इसलिए दोनों को समान दर्जा मिलना चाहिए।’
याचिका में कहा गया है कि कई ऐसी परिस्थितियां भी होती हैं जब वंदे मातरम गाने पर आपत्ति जाहिर की जाती है लेकिन यह सभी भारतीयों का दायित्व है कि वंदेमातरम जब भी गाया जाए तो उसका सम्मान करें। जब भारत को स्वतंत्रता दिलाने लिए आंदोलन चल रहा था तब वंदे मातरम पूरे देश का विचार और मोटो बन गया था। लोग वंदे मातरम गाते हुए जुलूस निकालते थे।
Vande Mataram should get equal respect as the national anthem, petition filed
New Delhi | [Court Bulletin] | A PIL (Public Interest Litigation) has been filed in the High Court of Delhi demanding that the national anthem ‘Vande Mataram’ be given equal respect to the national anthem ‘Jana Gana Mana’. It has been said in the petition that this song was sung a lot during the freedom movement. The court has been demanded to direct the central government to sing or play ‘Vande Mataram’ along with the national anthem every day in schools and other educational institutions. Advocate Ashwini Upadhyay has filed this petition.
The petition also demanded that the judgment given by the Madras Court and the Supreme Court on January 24, 1950, be complied with. In the petition, Ashwini said that it is the duty of all Indians to sing Vande Mataram and maintain the integrity of the country. Apart from this, it is also the responsibility of the government to promote Jana Gana Mana and Vande Mataram equally.
He said that there was no question of hurting anyone’s sentiments by Vande Mataram as the framers of the Constitution had said to respect it. “Jana Gana Mana has expressed sentiments keeping one nation in mind, while Vande Mataram talks about the character of the country, so both should get equal status,” the petition said.
It has been said in the petition that there are many such situations when objections are raised on singing Vande Mataram but it is the duty of all Indians to respect Vande Mataram whenever it is sung. Vande Mataram became the idea and motto of the whole country when the movement was going on for the independence of India. People used to take out processions singing Vande Mataram.
