जस्टिस अनु मल्होत्रा ​​ने कहा कि प्रतिवादियों को 4 सप्ताह के अंदर अपना जवाब दाखिल करने का आदेश देते हुए इस मामले को आगे की सुनवाई के लिए 26 जुलाई को सूचीबद्ध कर दिया।

 

हालांकि, अदालत ने इस स्तर पर पंजाब सरकार द्वारा दायर एक अन्य याचिका पर नोटिस जारी नहीं किया, जिसमें दिल्ली की एक जिला अदालत द्वारा पारित दो आदेशों को रद्द करने की मांग की गई थी। पहला आदेश बग्गा की तलाश और पेशी, दूसरा पंजाब पुलिस की हिरासत से उसका पक्ष सुने बिना उसकी रिहाई के आदेश से संबंधित है।

छह मई को पंजाब पुलिस ने बग्गा को उनके जनकपुरी स्थित घर से गिरफ्तार किया था, लेकिन दिल्ली पुलिस उन्हें हरियाणा से वापस ले आई थी। दिल्ली पुलिस का आरोप था कि उनके पंजाब समकक्ष ने उन्हें गिरफ्तारी के बारे में सूचना नहीं दी थी।

 

कथित रूप से भड़काऊ बयान देने, नफरत को बढ़ावा देने और आपराधिक धमकी देने के मामले में पंजाब पुलिस द्वारा बग्गा की गिरफ्तारी के बाद दिल्ली पुलिस ने छह मई की देर रात पंजाब पुलिस कर्मियों के खिलाफ अपहरण की एफआईआर दर्ज की थी।

 

पंजाब पुलिस ने अपनी याचिका में दावा किया है कि जब वे बग्गा की गिरफ्तारी के बारे में सूचित करने के लिए 6 मई को जनकपुरी थाने पहुंचे तो दिल्ली पुलिस ने इसमें सहयोग करने से इनकार कर दिया और उन्हें अवैध रूप से हिरासत में लिया।

 

याचिका में कहा गया है कि दिल्ली पुलिस ने पंजाब पुलिस के खिलाफ भारतीय दंड संहिता (आईपीसी) की धाराओं 452, 392, 342, 365, 295ए और 34 के तहत झूठी और मनगढ़ंत एफआईआर दर्ज की है। बग्गा की वैध गिरफ्तारी के प्रासंगिक और महत्वपूर्ण तथ्यों को छुपाकर तलाशी वारंट प्राप्त किया, जिसके बाद पंजाब पुलिस के अधिकारियों को हरियाणा पुलिस ने हिरासत में लिया और आरोपी की कानूनी हिरासत से वंचित कर दिया।

 

 

In Tajinder Bagga case, Punjab Police pleads for cancellation of kidnapping FIR

 

 

New Delhi | [Court Bulletin] | The Delhi High Court has sought Delhi Police’s response on the plea of ​​Punjab Police to quash the FIR registered in connection with the alleged abduction from the house of BJP leader Tajinder Pal Singh Bagga. The High Court has issued notice to Delhi Police, Delhi Government and Tajinder Bagga on the petition of Manpreet Singh, ACP (Rural) of SAS Nagar in Punjab.

 

Justice Anu Malhotra said that while ordering the respondents to file their reply within 4 weeks, the matter was listed for further hearing on July 26.

 

However, the court did not issue notice at this stage on another petition filed by the Punjab government, seeking quashing of two orders passed by a district court in Delhi. The first order pertains to the search and production of Bagga, the second to order his release from the custody of the Punjab Police without hearing his side.

 

The High Court said that it will go through the entire record of the case before arriving at any conclusion about the issue of notice on the petition.

 

On May 6, Bagga was arrested by the Punjab Police from his Janakpuri home, but Delhi Police brought him back from Haryana. The Delhi Police had alleged that their Punjab counterpart had not informed them about the arrest.

 

The Delhi Police registered a kidnapping FIR against Punjab Police personnel late on May 6, following the arrest of Bagga by Punjab Police for allegedly making provocative statements, promoting hatred and making criminal intimidation.

 

The Punjab Police, in its plea, has claimed that when they reached Janakpuri police station on May 6 to inform about Bagga’s arrest, the Delhi Police refused to cooperate and illegally detained him.

 

The petition states that Delhi Police has registered a false and fabricated FIR against Punjab Police under sections 452, 392, 342, 365, 295A and 34 of the Indian Penal Code (IPC). Obtained a search warrant by concealing relevant and important facts of the lawful arrest of Bagga, following which the Punjab Police officials were detained by the Haryana Police and denied the legal custody of the accused.
