नई दिल्ली | [कोर्ट बुलेटिन] | झारखंड हाई कोर्ट से मंगलवार को सुप्रीम कोर्ट ने कहा कि वह उस जनहित याचिका के सुनवाई योग्य होने संबंधी प्रारंभिक आपत्तियों पर पहले सुनवाई करे, जिसमें झारखंड के मुख्यमंत्री हेमंत सोरेन और उनके परिवार के सदस्यों और सहयोगियों द्वारा चलाई जा रही कुछ सेल कंपनियों के लेन-देन और खनन पट्टों की कथित मंजूरी की जांच का अनुरोध किया गया है।
न्यायमूर्ति डी वाई चंद्रचूड़ और न्यायमूर्ति बेला एम त्रिवेदी की अवकाशकालीन पीठ ने कहा कि हाई कोर्ट ने 13 मई के अपने आदेश में खुद कहा था कि वह पहले इस बात पर विचार करेगा कि शिव कुमार शर्मा द्वारा दायर जनहित याचिका सुनवाई योग्य है या नहीं और फिर वह याचिका में लगाए गए आरोपों के गुण-दोष पर गौर करेगा।
पीठ ने कहा, ”हमारा विचार है कि हाई कोर्ट रिट याचिका के सुनवाई योग्य होने संबंधी प्रारंभिक आपत्तियों पर पहले विचार करेगा और फिर कानून के अनुसार आगे बढ़ेगा।”शीर्ष अदालत ने यह भी स्पष्ट किया कि उसने मामले के गुण-दोष के संबंध में कोई टिप्पणी नहीं की है और न ही याचिका में लगाए गए आरोपों पर कोई टिप्पणी की है। उच्च न्यायालय के आदेश के खिलाफ झारखंड सरकार ने शीर्ष अदालत का रुख किया है।

New Delhi | [Court Bulletin] | The Supreme Court on Tuesday asked the Jharkhand High Court to first hear preliminary objections to the maintainability of a PIL in which transactions of certain SAIL companies run by Jharkhand Chief Minister Hemant Soren and his family members and associates were taken up. An inquiry has been requested into the alleged grant of transactions and mining leases.
A vacation bench of Justices DY Chandrachud and Bela M Trivedi said the High Court itself in its May 13 order had said that it would first consider whether the PIL filed by Shiv Kumar Sharma is maintainable or not and then He will look into the merits and demerits of the allegations made in the petition.
“We are of the view that the High Court will first consider the preliminary objections to the maintainability of the writ petition and then proceed in accordance with law,” the bench said. No comment has been made in this regard nor has any comment been made on the allegations made in the petition. The Jharkhand government has moved the apex court against the order of the High Court.
