नई दिल्ली | [कोर्ट बुलेटिन] | विमान यात्रा के दौरान मास्क नहीं पहने सहित कोरोना संक्रमण से बचाव के लिए जारी दिशा-निर्देशों का पालन नहीं किए जाने पर उच्च न्यायालय ने कड़ी नाराजगी जाहिर की है। उच्च न्यायालय ने ऐसे लोगों के खिलाफ कड़ी कार्रवाई करने का निर्देश दिया है, जो हवाई अड्डा और विमान में मास्क नहीं लगाने सहित कोरोना संक्रमण से बचाव के लिए जारी नियमों का उल्लंघन करते हैं।
दरअसल, उच्च न्यायालय के न्यायाधीश जस्टिस सी. हरिशंकर ने 8 मार्च को हवाई अड्डे से विमान में सवार होने जा रहे यात्रियों को बिना मास्क का देखा था। इसके बाद उन्होंने इस पर स्वत: संज्ञान लेकर इस मामले मुख्य न्यायाधीश की अगुवाई वाली पीठ के समक्ष भेज दिया था। अब इस मामले की अगली सुनवाई 18 जुलाई को होगी।
कार्यवाहक मुख्य न्यायाधीश विपिन सांघी और न्यायमूर्ति सचिन दत्ता की पीठ ने कहा है कि कोरोना महामारी अभी समाप्त नहीं हुई है और रह-रहकर अना सिर उठा रही है। पीठ ने कहा कि कोरोना संक्रमण से बचाव से जुड़े नियमों का उल्लंघन करने वाले लोगों के खिलाफ न सिर्फ मामला दर्ज होना चाहिए, बल्कि उन पर भारी जुर्माना भी लगाया जाना चाहिए। इतना ही नहीं, न्यायालय ने कहा कि ऐसे लोगों को ‘नो-फ्लाई यानी उड़ान निषेध की सूची में डाल देना चाहिए। पीठ ने कहा कि नियमों का पालन कराने के लिए सख्ती बहुत जरूरी है।
उच्च न्यायालय ने कहा है कि ऐसा कई बार देखा गया है कि नियमों का प्रभावी तरीके से पालन नहीं होता, इसलिए यह आवश्यक है कि नागर विमानन महानिदेशालय (डीजीसीए) समेत अन्य एजेंसियां नियमों का पालन सुनिश्चित करें। पीठ ने इसके लिए डीजीसीए को विमानन कंपनियों को अलग से बाध्याकारी निर्देश जारी करना चाहिए, ताकि वे हवाईअड्डों और विमानों में कर्मचारियों, एयर होस्टेस, कप्तान, पायलट व अन्य स्टाफ को उन यात्रियों के खिलाफ कड़ी कार्रवाई करने का अधिकार प्रदान करें, जो मास्क लगाने तथा हाथ धोने से जुड़े नियमों का उल्लंघन करते मिलते हैं।
हालांकि, इससे पहले नागर विमानन महानिदेशालय की ओर से अधिवक्ता अंजना गोसाईं ने पीठ को बताया कि नागरिक उड्डयन मंत्रालय ने 10 मई को एक अन्य आदेश जारी कर कोरोना संक्रमण से बचाव के लिए जारी दिशा-निर्देशों का पालन सुनिश्चित करने को कहा था। अधिवक्ता गोसाईं खुद कोरोना से संक्रमित हैं और वीडियो कांफ्रेंसिंग के जरिए उन्होंने मामले की सुनवाई में शामिल हुईं।
उन्होंने पीठ को बताया कि हवाईअड्डों और विमानों में मास्क से जुड़े नियमों पर कड़ाई से अमल करवाया जा रहा है। इस न्यायालय ने कहा कि मंत्रालय द्वारा 10 मई को जारी आदेश सही दिशा में उठाया गया कदम है क्योंकि महामारी अभी खत्म नहीं हुई है और रह-रहकर अपना सिर उठा रही है।

A bench of Acting Chief Justice Vipin Sanghi and Justice Sachin Dutta has said that the corona epidemic is not over yet and is raising its head continuously. The bench said that not only should a case be registered against those who violate the rules related to prevention of corona infection, but heavy fine should also be imposed on them. Not only this, the court said that such people should be put in the list of ‘no-fly’. The bench said that strictness is very necessary to ensure that the rules are followed.
The High Court has said that it has been observed many times that the rules are not followed effectively, so it is necessary that other agencies including the Directorate General of Civil Aviation (DGCA) ensure that the rules are followed. For this, the DGCA should issue separate binding instructions to the airlines, so that they empower the employees, air hostesses, captains, pilots and other staff in airports and aircraft to take strict action against those passengers who wear masks. And are found violating the rules related to washing hands.
However, before this, advocate Anjana Gosain, appearing for the Directorate General of Civil Aviation, told the bench that the Ministry of Civil Aviation had issued another order on May 10 to ensure compliance of the guidelines issued to prevent corona infection. Advocate Gosain himself is infected with Corona and he attended the hearing of the case through video conferencing.
He told the bench that the rules related to masks are being strictly implemented in airports and aircraft. This Court said that the order issued by the Ministry on May 10 is a step in the right direction as the pandemic is not over yet and is raising its head from time to time.
