योगी आदित्यनाथ ने 70 साल पुरानी (1941 वाली) ब्रिटिश जेल नियमावली को 16 अगस्त 2022 को निरस्त कर दिया। उसे आधुनिक बना दिया। अतः फांसी का यह दण्डारोपी रहा, पूर्व कैदी (1976 का डाइनामाइट केस वाला), मैं (श्रमजीवी पत्रकार) मुख्यमंत्री का कृतज्ञ हूं। हमारी पुरानी जनवादी मांग उन्होंने स्वीकारी। नारकीय कारागारों को खत्म कर, मानवीय बना दिया। जेल में जन्मे शिशु कृष्ण के अवतार की बेला पर ये समस्त सुधार घोषित हुये हैं। क्या संयोग है! या माकूल मुहूर्त?

लेकिन कोफ्त तो होती है। खलिश, खासकर! राज-काज चलाने वाले अधिकतर मंत्री, 8 प्रधानमंत्री और बहुतेरे मुख्यमंत्री जेल काट चुके हैं, फिर भी भारत की जेलों में पूरी सदी के दरम्यान पर्याप्त सुधार हुए ही नहीं। माना कि ‘‘जेल होटल नहीं हो सकता।‘‘ यही कहा था इन्दिरा गांधी के गृह राज्यमंत्री ओम मेहता ने अपने समधी बलिया के सांसद ठाकुर चन्द्रशेखर सिंह से, जब 2 लाख विरोधियों को इमरजेन्सी (1975) में जेल में ठूँसा गया था। लेकिन यह भी सच है कि कानून और व्यवस्था का एक अदना हिस्सा ही जेल अब हो गया था। पुलिस तथा न्यायपालिका से जुड़कर जेल एक नुकीला त्रिभुज बनाता है। न्यायिक हिरासत जेल व्यवस्था का खास अंग है। कठोर और निर्मम।

भारत में आधुनिक जेलों का निर्माण करने वाली ब्रिटिश सरकार ने राजनेता जान हावार्ड के आन्दोलन पर जेल सुधार कार्यक्रम अपनाया था। भारत में अंग्रेजी शासन वाले प्रांतों में 1920 में एक सुधार समिति बनी थी। इसने जेल कानून में संशोधन और सूचारू प्रबंध में प्रशिक्षित कर्मियों के आवश्यकता पर बल दिया था।

इसके अध्यक्ष एलेक्सेंडर कार्डयू ने कैदियों के पुनर्वास के लिये कारगर योजना सुझायी थी। बाद में जवाहरलाल नेहरू के राज्य के दौरान 1957 में डब्लयू. सी. रेक्लूज की अध्यक्षता में जेल सुधार समिति बनी। इसने राष्ट्रीय जेल मैनुअल नियामावली की रचना का प्रस्ताव किया था।

इसी दिशा में 1972 में इंदिरा गाँधी ने जेल सुधार कार्यदल स्थापित किया था। मगर जनापेक्षा 1977 में बढ़ी थी, जब सिवाय जगजीवन राम तथा हेमवती नंदन बहुगुणा के, सारे केन्द्रीय काबीना के मंत्रीगण ने जेल से रिहा होकर अपने पद और गोपनीयता की शपथ ली थी।

मगर मोरारजी देसाई की इस जनता पार्टी सरकार ने जेल से सरकार में आने पर भी जेल सुधार को प्राथमिकता के तौर पर लिया ही नहीं। एक मील का पत्थर 1980 में आया था, जब न्यायमूर्ति आनन्द नारायण की अध्यक्षता में जेल सुधार समिति इंदिरा गांधी ने बनायी थी। इसकी रपट ठंडे बस्ते में रह गयी।

तो योगी ने अब बहुत सत्कार्य किया। महिला कैदियों को सधवा बना दिया! गिरफ्तारी पर इन बन्दिनियों का मंगलसूत्र जमा करा लिया जाता था। अब परिष्कृत जेल नियमावली के अनुसार वे सधवा के इस भूषण को पहने रहेंगी। इन ऋतुमतियों को स्वच्छता (सेनिटरी) पैड मिलेगा। शैंपू और तेल भी। परिधान में शलवार-कुर्ती पहनने की अनुमति होगी। शिशुओं की देखरेख, नामकरण वाले अनुष्ठान आदि होंगे। गर्भवती कैदी को पौष्टिक आहार उपलब्ध होगा, टीकाकरण, औषधियां भी। सरसों के तेल की जगह अब रिफाइंड तेल मिलेगा। बेकरी खुलेगी।

पुरूष कैदी को मुड़ाई, कटाई और छटायी के साथ दाढ़ी की हजामत (भुगतान पर) का नियम बना है। सारी सूचनायें अब कम्प्यूटर पर दर्ज होंगी। कारागार राज्यमंत्री धर्मवीर प्रजापति ने बताया कि पर्वों पर पकवान, रोजेदारों को खजूर और उपवास पर गुड़ दिया जायेगा। याद आया, बड़ौदा जेल में मुझे नाश्ते में केवल गुड़-चना ही मिलता था। चना तो चिड़ियों को और गुड़ चीटियों को मैं खिला देता था। बागवानी खूब करता था। सैकड़ों तुलसी के पौधे रोपे। जेलर पण्डया मुदित होते थे।

Yogi Adityanath repealed the 70-year-old (1941) British Prison Manual on 16 August 2022. modernized it. Therefore, this convict of hanging, former prisoner (in the dynamite case of 1976), I (working journalist) am grateful to the Chief Minister. He accepted our old democratic demand. Humanized, abolished hellish prisons. All these reforms have been declared on the time of the incarnation of the infant Krishna, born in jail. What a coincidence! Or the right time?

But there is anger. Sorry, especially! Most of the ministers, 8 prime ministers and many chief ministers have been jailed, yet the prisons of India have not undergone substantial reforms during the whole century. Admittedly, “jail cannot be a hotel.” This is what Indira Gandhi’s Minister of State for Home Om Mehta said to his colleague, Ballia MP Thakur Chandrashekhar Singh, when 2 lakh opponents were imprisoned in Emergency (1975). But it is also true that only a minor part of law and order had become prison. Joining the police and the judiciary, the prison forms a pointed triangle. Judicial custody is a special part of the prison system. harsh and ruthless.

The British government, which built modern prisons in India, adopted a prison reform program on the movement of politician John Howard. A reform committee was formed in 1920 in the British-ruled provinces in India. It emphasized the need for amending the prison law and trained personnel in the smooth management.

Its president, Alexandre Cardu, suggested an effective plan for the rehabilitation of prisoners. Later in 1957 during the reign of Jawaharlal Nehru. Prison reform committee was formed under the chairmanship of C. Recluse. It proposed the creation of the National Prison Manual Niyamavali.

In 1972, Indira Gandhi set up the Jail Reform Task Force in this direction. But public expectation was raised in 1977, when all the ministers of the central cabinet, except Jagjivan Ram and Hemvati Nandan Bahuguna, were released from jail and took oath of their office and secrecy.

But this Janata Party government of Morarji Desai did not take prison reform as a priority even after coming to the government from jail. A milestone came in 1980, when the Prison Reforms Committee headed by Justice Anand Narayan was formed by Indira Gandhi. Its report was left in cold storage.

So Yogi has now done a lot of work. Made female prisoners clean! On arrest, the mangalsutra of these prisoners was deposited. Now she will continue to wear this Bhushan of Sadhwa as per the sophisticated jail manual. These seasonals will get sanitary pads. Shampoo and oil too. Wearing of shalwar-kurti will be allowed in the dress. There will be babysitting, naming rituals etc. Nutritious food will be available to the pregnant prisoner, vaccination, medicines will also be available. Refined oil will now be available instead of mustard oil. The bakery will open.

The male prisoner has been made to shave, shave and trim his beard (on payment). All the information will now be recorded on the computer. Minister of State for Prisons, Dharamveer Prajapati said that on festivals, dates will be given to the Rojedars and jaggery will be given on fasting. I remembered, in Baroda jail, I used to get only jaggery and chana for breakfast. I used to feed gram to the birds and jaggery to the ants. He used to do gardening a lot. Planted hundreds of Tulsi plants. Jailor Pandya used to be mudd.
