नई दिल्ली | [कोर्ट बुलेटिन] | दिल्ली हाईकोर्ट के जस्टिस डी.के. शर्मा ने निचली अदालत के उस आदेश को चुनौती देने वाली याचिका पर विचार करते हुए कहा है कि वह जिला अदालतों के रोजमर्रा के कामकाज को नियंत्रण नहीं कर सकता। न्यायालय ने स्पष्ट किया कि पुनरीक्षण शक्तियों का इस्तेमाल को निचली अदालत के दिन-प्रतिदिन के कामकाज को नियंत्रित करने के रूप में नहीं देखा जा सकता है।

जस्टिस डी.के. शर्मा ने यह टिप्पणी स्थानीय आयुक्त नियुक्त करने की याचिकाकर्ता के मांग को खारिज करते हुए कहा। उन्होंने कहा कि अदालतों में लंबित मामलों को त्वरित निपटारे के लिए साक्ष्य दर्ज करने के लिए स्थानीय आयुक्त को नियुक्त करने की प्रथा को प्रोत्साहित किया जा रहा है।

 

हालांकि, हाईकोर्ट ने साफ कर दिया कि निचली अदालत को मामले के तथ्यों और परिस्थितियों पर गौर करना होगा। हाईकोर्ट ने कहा है कि इन मुद्दों पर फैसला करने के लिए निचली अदालत सबसे अच्छा मंच है क्योंकि वहां मामले का ट्रायल (सुनवाई्) चल रहा है।

 

उन्होंने कहा कि हाईकोर्ट को अपनी पुनरीक्षण शक्ति का प्रयोग करते हुए निचली अदालत के रोजमर्रा के कामकाज को नियंत्रित करने के रूप में नहीं देखा जा सकता है।

 

जस्टिस शर्मा ने यह भी कहा कि यदि पक्षकारों की सहमति है, तो अदालतें कमीशन जारी करते हुए स्थानीय आयुक्त नियुक्त कर सकते हैं। साथ ही कहा है कि यदि कोई भी एक पक्ष सहमत नहीं है, तो अदालतों को मामले के तथ्यों और परिस्थितियों पर विचार करना होगा।

 

हाईकोर्ट ने कहा है कि दोनों पक्षकारों की सहमति नहीं होने पर मामले में नियुक्त स्थानीय आयुक्त को काफी परेशानियों का सामना करना होता है।

 

मौजूदा मामले में प्रतिवादी ने स्थानीय आयुक्त नियुक्त करके साक्ष्य दर्ज करने की प्रक्रिया और इसकी मांग पर कड़ी आपत्ति दर्ज कराई थी। साथ ही प्रतिवादी ने स्थानीय आयुक्त के शुल्क का 50 फीसदी खर्च भी वहन करने से इनकार कर दिया था।

 

दूसरी तरफ याचिकाकर्ता ने कहा कि यदि साक्ष्य दर्ज करने के लिए मामले में स्थानीय आयुक्त नियुक्त नहीं किए जाते हैं तो इसके निपटारे में 10 साल का वक्त लग जाएगा।

 

सभी तथ्यों पर विचार करने के बाद हाईकोर्ट ने निचली अदालत के फैसले में हस्तक्षेप करने से इनकार करते हुए मामले में स्थानीय आयुक्त नियुक्त करने की मांग को लेकर दाखिल याचिका को खारिज कर दिया।

High Court said – cannot control the day-to-day functioning of lower courts

 

 

New Delhi | [Court Bulletin] | Delhi High Court Justice D.K. Sharma, while considering the petition challenging the order of the trial court, said that he cannot control the day-to-day functioning of the district courts. The Court clarified that the exercise of revisional powers cannot be seen as controlling the day-to-day functioning of the trial court.

 

Justice D.K. Sharma made this remark while rejecting the petitioner’s demand to appoint a local commissioner. He said the practice of appointing a local commissioner to record evidence for speedy disposal of cases pending in courts is being encouraged.

 

However, the High Court made it clear that the trial court will have to look into the facts and circumstances of the case. The High Court has said that the trial court is the best forum to decide these issues as the trial of the case is going on there.

 

He said that the High Court cannot be seen as controlling the day-to-day functioning of the lower court in the exercise of its revisional power.

 

Justice Sharma also said that if the parties agree, the courts can appoint local commissioners by issuing commissions. It has also been said that if either of the parties does not agree, then the courts will have to consider the facts and circumstances of the case.

 

The High Court has observed that in the absence of the consent of both the parties, the local commissioner appointed in the case has to face a lot of trouble.

 

In the present case the respondent had lodged a strong objection to the process of recording of evidence and its demand by appointing a local commissioner. Also the respondent had refused to bear 50 per cent of the fee of the local commissioner.

 

On the other hand, the petitioner said that if the local commissioner is not appointed in the case to record the evidence, then it will take 10 years for its disposal.

 

After considering all the facts, the High Court, refusing to interfere with the decision of the lower court, dismissed the petition seeking appointment of a local commissioner in the matter.
