अहमदाबाद | [कोर्ट बुलेटिन] | गोधरा कांड के दौरान 5 माह की गर्भवती महिला से बलात्कार के सभी 11 आरोपियों को 21 जनवरी 2008 को मुंबई में एक स्पेशल सीबीआई कोर्ट ने उम्रकैद की सजा सुनाई थी। बिल्किस बानो रेप केस में उम्रकैद की सजा भुगत रहे सभी 11 कैदियों को गुजरात सरकार की माफी योजना के तहत रिहा कर दिया गया है। यह सभी गोधरा की उपजेल में बंद थे। गुजरात सरकार की माफी योजना के तहत इन सभी को जेल से छोड़ा गया है। यह सभी 2002 के गोधरा कांड में बिल्किस बानों के साथ गैंगरेप के मामले में उम्रकैद की सजा काट रहे थे।

बता दें कि गोधरा ट्रेन अग्निकांड की घटना के बाद गुजरात में भड़की सांप्रदायिक हिंसा के दौरान मार्च, 2002 में 5 माह की गर्भवती बिल्किस बानो के साथ गैंगरेप हुआ था। इस हिंसा में उसके परिवार के 7 सदस्यों को भी मार डाला गया था। वहीं जबकि परिवार के 6 अन्य सदस्य किसी तरह से बचकर भाग निकले थे।

मुंबई में एक स्पेशल सीबीआई कोर्ट ने 21 जनवरी 2008 को 11 लोगों को इस बिल्किस बानो रेप केस में उम्रकैद की सजा सुनाई थी। इन सभी के ऊपर बिल्किस बानो के साथ रेप और उनके परिवार के सात सदस्यों की हत्या का आरोप लगाया गया था। बाद में बॉम्बे हाईकोर्ट ने भी स्पेशल सीबीआई कोर्ट का फैसला बरकरार रखा था।

उम्रकैद के यह सभी दोषी जेल में 15 साल की सजा काट चुके थे। इसके बाद एक कैदी ने सुप्रीम कोर्ट का रुख किया और खुद को समय से पूर्व रिहा किए जाने की याचिका दायर की। इसके बाद शीर्ष अदालत ने गुजरात सरकार को इस मामले को देखने के निर्देश दिए थे कि क्या इन्हें राज्य सरकार द्वारा माफी दी जा सकती है।

सुप्रीम कोर्ट के निर्देश के बाद गुजरात सरकार ने एक कमेटी बनाई। इस कमेटी को पंचमहल के कलेक्टर सूजल माएत्रा हेड कर रहे थे। उन्होंने कहा कि इस कमेटी ने एकमत से फैसला लिया कि सभी 11 आरोपियों को माफी दे दी चाहिए। कमेटी के इस फैसले से राज्य सरकार को अवगत करा दिया गया था। इसके बाद इन सभी को जेल से छोड़ने का आदेश जारी हुआ।

क्या था मामला

2002 के गुजरात दंगों के दौरान बिलकिस बनो के पूरे परिवार के 7 सदस्यों को मौत के घाट उतार दिया गया, जानकी 6 अन्य किसी तरह अपनी जान बचा कर भागने में सफल हुए थे।। हत्या से पहले घर की महिलाओं से बलात्कार किया गया। बिलकिस बनो उस वक़्त 5 महीने की प्रेग्नेंट थीं, इसके बावजूद इन 11 हैवानों ने बलात्कार किया। बेहोश होने पर बिलकिस बानो को मरा हुआ समझ छोड़कर भाग गए।

होश में आने के बाद बिलकिस बनो ने न्याय के लिए लंबी लड़ाई लड़ी। इस लड़ाई में उनके साथी बने उनके पति और सामाजिक संगठन।

2008 में मुंबई में सीबीआई की विशेष अदालत ने बिलकिस बनो के परिवार के 7 सदस्यों के बलात्कार और हत्या के आरोप में सभी 11 अपराधियों को उम्रकैद की सज़ा सुनाई, बाद बॉम्बे हाईकोर्ट ने भी सज़ा को बरकरार रखा।

‘Azadi’ to all 11 life prisoners of Bilkis Bano rape, incident happened during Godhra incident

All 11 prisoners serving life imprisonment in the Bilkis Bano rape case have been released under the amnesty scheme of the Gujarat government. All of them were lodged in the sub-jail of Godhra. All of them have been released from jail under the amnesty scheme of the Gujarat government. All of them were serving life sentences for the 2002 Godhra gangrape with Bilkis Bano.

Let us inform that during the communal violence that erupted in Gujarat after the Godhra train fire incident, in March 2002, 5 months pregnant Bilkis Bano was gang-raped. 7 members of his family were also killed in this violence. Whereas 6 other members of the family had somehow escaped.

On January 21, 2008, a special CBI court in Mumbai sentenced 11 people to life imprisonment in the Bilkis Bano rape case. All of them were accused of raping Bilkis Bano and killing seven of his family members. Later the Bombay High Court also upheld the decision of the Special CBI Court.

All these convicts of life imprisonment had served 15 years in jail. After this a prisoner moved the Supreme Court and filed a petition seeking his premature release. Following this, the apex court had directed the Gujarat government to look into the matter whether they can be pardoned by the state government.

Following the direction of the Supreme Court, the Gujarat government formed a committee. This committee was headed by Panchmahal Collector Sujal Maetra. He said that this committee unanimously decided that all the 11 accused should be pardoned. The state government was informed about this decision of the committee. After this an order was issued to release all of them from jail.

what was the matter

During the 2002 Gujarat riots, 7 members of the entire family of Bilkis Bano were put to death, Janaki 6 others somehow managed to escape with their lives. The women of the house were raped before the murder. Bilkis Bano was 5 months pregnant at that time, in spite of this these 11 haiwans raped her. When he fainted, Bilkis fled leaving Bano to be dead.

After regaining consciousness, Bilkis Bano fought a long battle for justice. Her husband and social organization became her companions in this fight.

In 2008, a special CBI court in Mumbai sentenced all 11 criminals to life imprisonment for the rape and murder of 7 members of Bilkis Bano’s family, after the Bombay High Court also upheld the sentence.
