नई दिल्ली | [नेशनल बुलेटिन] | केंद्र और गुजरात दोनों जगहों पर बीजेपी (भारतीय जनता पार्टी) की सरकार है, लेकिन बिल्किस बानो रेप केस के आरोपियों की रिहाई के मामले में दोनों के बीच सामंजस्य के अभाव की बात सामने आई है। बताया जा रहा है कि इन आरोपियों की रिहाई में राज्य सरकार ने केंद्र की मोदी सरकार द्वारा दी गई गाडलाइंस को दरकिनार कर दिया गया है।
कहा जा रहा है कि आजादी का अमृत महोत्सव के दौरान जिन कैदियों के रिहाई के लिए केंद्र की मोदी सरकार की तरफ से अनुमति मिली थी, उसमें रेप के आरोपी शामिल नहीं थे। इसके बावजूद गुजरात भाजपा सरकार ने बिल्किस बानो रेप केस में उम्रकैद की सजा काट रहे सभी 11 दोषियों को आजाद कर दिया।
केंद्र ने यह दिया था दिशा-निर्देश
इस साल जून में आजादी के अमृत महोत्सव के तहत केंद्र सरकार ने राज्यों के लिए एक दिशा-निर्देश जारी किया था। इसके तहत जेल में लंबे समय से सजा काट रहे अपराधियों को छोड़ने के लिए स्पेशल पॉलिसी का प्रस्ताव दिया गया था। हालांकि इसमें रेप केस में सजा काट रहे अपराधियों को छोड़ने का प्रावधान नहीं था।
इस तरह तकनीकी रूप से देखें तो बिल्किस बानो रेप केस के आरोपी इस गाइडलाइन के मुताबिक नहीं छोड़े जा सकते थे, लेकिन इस मामले में गुजरात भाजपा सरकार ने अपनी पॉलिसी का पालन किया और माफी याचिका पर सुप्रीम कोर्ट द्वारा मई में दिए गए निर्देशों के तहत इन्हें जेल से छोड़ दिया।
क्राइटेरिया का पूरी तरह से पालन नहीं
हालांकि इसके बावजूद गुजरात भाजपा सरकार यह फैसला रेप केस के मुजरिमों को न छोड़ने के केंद्र सरकार के सिद्धांत के खिलाफ चला गया है। सिर्फ इतना ही नहीं, गृह मंत्रालय की वेबसाइट पर मौजूद केंद्र सरकार की गाइडलाइंस में एक प्वॉइंट यह भी है कि उम्रकैद की सजा पाने वालों को भी नहीं छोड़ना है।
इस तरह से भी बिल्किस बानो रेप केस के 11 आरोपी इस क्राइटेरिया को फॉलो नहीं करते। वहीं गोधरा उपजेल से बाहर आने के बाद आरोपियों का मिठाई खिलाकर स्वागत किया गया। जेल से बाहर आने के बाद याचिका लगाने वाले राधेश्याम शाह ने इस पर खुशी जताई। उनकी याचिका पर ही रिहाई का फैसला हुआ है। राधेश्याम ने कहा कि अब मैं अपने परिवार से मिलूंगा और एक नई जिंदगी की शुरुआत करूंगा।
2002 में हुई थी घटना
गौरतलब है कि 2002 में गोधरा दंगों के दौरान बिल्किस बानों के साथ गैंगरेप हुआ था। इस दौरान उसके परिवार के 7 सदस्यों की हत्या भी कर दी गई थी। उस वक्त बिल्किस बानो की उम्र 21 साल थी और वह 5 माह की गर्भवती भी थी। 3 मार्च 2002 को हुई इस घटना में बिल्किस के परिवार के 6 सदस्यों के साथ उसकी मासूम बच्ची की भी हत्या कर दी गई थी।
2008 में मुंबई सीबीआई की स्पेशल कोर्ट ने इस मामले में 11 दोषियों को आजीवन उम्रकैद की सजा सुनाई थी। बाद में बॉम्बे हाई कोर्ट ने भी इस सजा को बरकरार रखा था। बता दें कि आरोपियों की रिहाई पर बिल्किस बानो के परिवार ने भी हैरानी जताई है। साथ ही उन्होंने यह भी कहा कि उन्हें इस प्रक्रिया के बारे में जानकारी नहीं दी गई थी।

In this way technically, the accused in the Bilkis Bano rape case could not be released according to this guideline, but in this case the Gujarat BJP government followed its policy and on the apology petition under the directions given by the Supreme Court in May. Released them from jail.
Not complying with the criteria completely
However, despite this, the Gujarat BJP government has gone against the central government’s principle of not releasing the perpetrators of the rape case. Not only this, there is also a point in the guidelines of the Central Government present on the website of the Ministry of Home Affairs that even those sentenced to life imprisonment should not be spared.
In this way also the 11 accused in the Bilkis Bano rape case do not follow this criteria. On the other hand, after coming out of Godhra subjail, the accused were welcomed with sweets. Radheshyam Shah, who filed the petition after coming out of jail, expressed happiness over this. The decision to release has been taken only on his petition. Radheshyam said that now I will meet my family and start a new life.
The incident happened in 2002
Significantly, during the 2002 Godhra riots, Bilkis Bano was gang-raped. During this 7 members of his family were also murdered. At that time Bilkis Bano was 21 years old and she was also 5 months pregnant. In this incident that took place on March 3, 2002, along with six members of Bilkis’s family, her innocent child was also murdered.
In 2008, the special court of Mumbai CBI had sentenced 11 convicts to life imprisonment in this case. Later the Bombay High Court also upheld this sentence. Let us inform that the family of Bilkis Bano has also expressed surprise over the release of the accused. He also said that he was not informed about the process.
