नई दिल्ली | [नेशनल बुलेटिन] | Chhattisgarh Gompad Massacre: सुप्रीम कोर्ट ने पिछले दिनों में अपने एक फैसले में सामाजिक कार्यकर्ता हिमांशु कुमार पर 5 लाख रुपये का जुर्माना लगाया था। यह मामला 2009 का है, जिसमें छत्तीसगढ़ के दंतेवाड़ा जिले के गचनपल्ली, गोम्पड (Chhattisgarh Gompad Massacre) और बेलपोचा क्षेत्रों में आदिवासी समुदाय के लोगों के साथ बलात्कार, लूटपाट और मर्डर की घटना सामने आई थी। हिमांशु कुमार ने इन घटनाओं में 16 ग्रामीणों की मौत का दावा किया था।
उन्होंने खुद के रिकॉर्ड किए गए बयान के आधार पर सर्वोच्च अदालत में याचिका दायर की थी। मामले की सुनवाई जस्टिस एएम खानविलकर और जस्टिस जेबी पारदीवाला की बेंच ने की है। केंद्र सरकार ने अदालत में याचिकाकर्ता को झूठे सबूत पेश करने का दोषी ठहराने की प्रार्थना की थी। इस बाबत हिमांशु का कहना है कि वे जुर्माने की राशि जमा नहीं कराएंगे। सुप्रीम कोर्ट का यह फैसला नहीं मानेंगे, क्योंकि ये ठीक नहीं है।
‘गन-रेप-मर्डर’ के पीड़ित आदिवासियों की ये लड़ाई, अब बस्तर से बाहर निकलकर दिल्ली पहुंचेगी। अगले सप्ताह पीड़ित आदिवासी दिल्ली आएंगे और अदालत के सामने अपने साथ हुए पुलिस एवं सुरक्षा बलों के जुल्मों की सच्ची तस्वीर पेश करेंगे। ये फैसला, चंद उद्योगपतियों के हितों के लिए आदिवासियों के संघर्ष को खत्म करने का प्रयास है।
क्या बदनाम करने के लिए लगाई गई थी याचिका?
आदिवासियों के लिए संघर्षरत सामाजिक कार्यकर्ता सोनी सोरी, नंदिनी सुंदर, प्रो. लक्ष्मण यादव, भीम आर्मी के राष्ट्रीय अध्यक्ष चंद्रशेखर आजाद, लेखिका अरुंधति राय और सुप्रीम कोर्ट के वरिष्ठ अधिवक्ता प्रशांत भूषण ने इस मुद्दे पर शुक्रवार को प्रेस क्लब में अपना पक्ष रखा।
केंद्र सरकार ने सर्वोच्च अदालत के समक्ष हिमांशु कुमार की दलीलों को पूरी तरह से झूठी, मनगढ़ंत और धोखा देने वाली बताया था। याचिकाकर्ता का मकसद वामपंथी चरमपंथियों को सुरक्षा बलों द्वारा नरसंहार किए गए निर्दोष जनजातीय पीड़ितों के तौर पर दिखाना है। उस वक्त पुलिस ने गोम्पड गांव के बाहरी क्षेत्र से 7 लोगों के शव बरामद किए थे।
सर्वोच्च अदालत ने सामाजिक कार्यकर्ता हिमांशु कुमार के खिलाफ, सरकार को कार्रवाई की अनुमति दी है। सरकार, याचिकाकर्ता के खिलाफ केस दर्ज कर सकती है। हिमांशु कुमार ने अपनी याचिका में मौतों की जांच कराने की मांग की थी। सर्वोच्च अदालत में कहा, क्या उन्होंने जानबूझकर सुरक्षाकर्मियों को बदनाम करने और वामपंथी चरमपंथियों की मदद करने के लिए जनहित याचिका दायर की थी।
आदिवासियों की लड़ाई को कमजोर किया जा रहा है: सोनी
सोनी सोरी ने कहा, आदिवासियों की लड़ाई कमजोर की जा रही है। 5 लाख जुर्माना लगाया गया। इसकी चिंता करने की जरूरत है। आने वाले समय में दूसरे लोगों पर भी जुर्माना होगा। मुझे झूठे केसों में 11 साल तक लड़ाई लड़नी पड़ी। मेरा केस भी सुप्रीम कोर्ट में है। बतौर सोनी सोरी, मुझे असहनीय पीड़ा दी गई। करंट दिया गया। प्राइवेट पार्ट में पत्थर डाले गए। हम सच्चाई की लड़ाई लड़ रहे हैं।
सुप्रीम कोर्ट तो कल मेरे खिलाफ भी जुर्माना लगा देगा कि मैं झूठा केस लड़ रही हूं। गोम्पड में जिस बच्चे का हाथ काटा गया, वह 9वीं कक्षा में पढ़ता है। आज भी बस्तर में महिलाओं के साथ रोजाना बलात्कार हो रहा है। पुलिस कुछ नहीं करती। गर्भवती महिलाओं को भी नहीं छोड़ते। पुलिस और सुरक्षा कर्मी, उनके वीडियो बनाते हैं। क्या ये घटना सुप्रीम कोर्ट को नहीं दिखाई दे रही।
नंदराज पहाड़ को बचाने वालों के साथ क्या किया गया
बतौर सोनी सोरी, 2019 में छत्तीसगढ़ के दंतेवाड़ा में बैलाडीला की पहाड़ियों को बचाने के लिए आदिवासी बाहर निकले। नंदराज पहाड़, उनके जीवन के कष्ट दूर कर रहा था, उसके चलते वहां बरसात आती थी। पानी बचता था। उद्योगपतियों के हितों के लिए पहाड़ को खत्म करने का प्रयास किया गया। वहां से महिलाओं को उठाकर ले गए। पहले उनके पैरों में गोली मारी जाती है, उसके बाद बलात्कार की घटनाएं होती हैं। ये आदिवासी लड़ाई को कमजोर करने का एक तरीका ही तो है।
डीआरजी और बस्तर बटालियन वाले कहते हैं कि हम शिकारी हैं। शिकार करने आए हैं। महिलाओं व लड़कियों को ले जाते हैं। हम नवनिर्वाचित राष्ट्रपति द्रौपदी मुर्मू से मुलाकात करेंगे कि वे बस्तर के लोगों से बात करें। 2017 में सुकमा जिले के बुर्कापाल गांव के पास नक्सली हमले में सीआरपीएफ के 25 जवान शहीद हो गए थे। 121 आरोपियों को जेल में ठूंसा गया। अब वे सब बरी हो गए हैं। वे लोग अब क्या करेंगे। उनका कुछ नहीं बचा है। क्या अदालत, केंद्र और राज्य सरकार, उनके लिए कोई आदेश दे सकती है।

जिन पर आरोप हैं, वही जांच कर रहे हैं: प्रशांत भूषण
वरिष्ठ अधिवक्ता प्रशांत भूषण ने कहा, आदिवासियों को झूठे केसों में बंद किया गया। आदिवासियों के साथ ऐसा क्यों हो रहा है। एक केस सुप्रीम कोर्ट में है। एक बड़े उद्योगपति को कोयले की खान देने के लिए नियम ताक पर रखे जा रहे हैं। सुप्रीम कोर्ट ने 2009 के मामले में कहा, वहां की पुलिस जांच कर चुकी है। बतौर प्रशांत भूषण, जिन पर आरोप हैं, वही जांच कर रहे हैं। ये तो हैरानी की बात है।
हिमांशु कुमार पर ही 5 लाख रुपये का जुर्माना लगा दिया। इसमें एक अपील तो होनी चाहिए। पूर्व सीजेआई दीपक मिश्रा से जुड़े एक मामले में हमने अदालत से कहा कि इसकी जांच के लिए स्वतंत्र एसआईटी का गठन हो। तब वह याचिका ही खारिज कर दी गई। हमारी संस्था पर 25 लाख रुपये का जुर्माना लगा दिया।
उन्होंने आरोप लगाया कि जिस पुलिस पर फर्जी मुठभेड़ का आरोप है, अदालत ने उन्हीं की बात मान ली। प्रशांत भूषण ने कहा कि बीते कुछ दिनों में सर्वोच्च अदालत ने कुछ अच्छे फैसले भी दिए हैं लेकिन रिटायरमेंट के बाद पद की लालसा न्याय पर भारी पड़ रही है।
गरीबों के संसाधनों पर कब्जा किया जा रहा है: हिमांशु कुमार
हिमांशु कुमार ने कहा, गरीबों के संसाधनों पर कब्जा किया जा रहा है। अमीरों की तिजोरी भरने के लिए आदिवासी इलाकों में सुरक्षा बल भेजे जाते हैं। आदिवासी इलाकों में एक छिपा हुआ युद्ध चल रहा है, जिसमें बंदूक, बम और रेप सब कुछ है। केंद्रीय बल, वहां अत्याचार कर रहे हैं। नंदिनी सुंदर के मामले में कोई शिकायत नहीं दे रहा था। इस पर 519 एफआईआर, जिला पुलिस और सुप्रीम कोर्ट को दी, लेकिन कुछ नहीं हुआ। गोम्पड केस में झूठ बोल रहे हैं।
अदालत कहती है कि जब पुलिस ने एफआईआर लिख ली है तो कोर्ट में नहीं आना चाहिए था। अरे भाई पुलिस तो हत्या में शामिल थी। उसकी जांच पर भरोसा कैसे कर लें। 6 लोगों को पुलिस वाले सादे कपड़ों में पकड़ कर ले गए। उन्हें बंदूक का डर दिखाया। 6 माह तक कस्टडी में रखा। इसके बाद भी उन्होंने अपने बयान में ये नहीं कहा कि याचिका झूठी है। उन्होंने कहा कि हम आरोपियों को नहीं पहचानते।
ये सत्ता से डरे हुए लोगों का फैसला है
बतौर हिमांशु कुमार, सुप्रीम कोर्ट का ये फैसला, सत्ता से डरे हुए लोगों का फैसला है। अगर हम 5 लाख रुपये देते हैं तो सारे आदिवासी झूठे हो जाएंगे। अब वे दिल्ली आकर न्याय मांगेंगे। अरुंधती राय ने कहा, हिमांशु कुमार का आश्रम जमींदोज कर दिया गया। ‘ग्रीन हंट’ ऑपरेशन में 600 लोगों को जलाया गया, महिलाओं के साथ रेप हुए। कंपनियों के एमओयू साइन हो रहे थे। उद्योगपतियों ने सरकार को प्रभाव में ले लिया। आदिवासियों को सुरक्षा का डर दिखाया गया।
जब मैं जंगल में गई तो ऐसी महिलाओं से मिली, जिनके साथ दरिंदगी की गई। कामरेड कमला का जिक्र करते हुए राय ने कहा, उसका रेप तब तक होता रहा, जब तक नीचे की घास खत्म नहीं हो गई। इतना बलात्कार किया गया। आदिवासी की लड़ाई अब बाहर आ रही है। हर सूरत में जमीन और जंगल को बचाना है। इस लड़ाई में हम बाकी बचे लोगों को भी सरकार जेल में बंद कर सकती है।
