नई दिल्ली | [कोर्ट बुलेटिन] | राजधानी के एक निजी स्कूल को हाईकोर्ट ने आदेश दिया है कि वह सेवानिवृत हो चुके अपने शिक्षकों को 7वें वेतन आयोग की सिफारिश के अनुसार वेतन व भत्ता दें। हाईकोर्ट ने स्कूल प्रबंधन को एक माह के भीतर सेवानिवृत शिक्षकों को जनवरी, 2016 से सेवानिवृत होने तक 7वें वेतन आयोग की सिफारिश के अनुसार वेतन-भत्ता का निर्धारण करके बकाया रकम का भुगतान करने का आदेश दिया।

जस्टिस वी. कामेश्वर राव ने गीता बाल भारती सीनियर सेकेंडरी स्कूल की 5 सेवानिवृत शिक्षकों की ओर से दाखिल याचिका का निपटारा करते हुए दिया है।

न्यायालय ने स्कूल प्रबंधन के उन दलीलों को सिरे से खारिज कर दिया, जिसमें कहा गया था कि अक्तूबर, 2018 से पहले सेवानिवृत शिक्षकों को इसका लाभ नहीं दिया जा सकता क्योंकि उसने अक्तूबर, 2018 से 7वें वेतन आयोग की सिफारिश को लागू किया।

स्कूल प्रबंधन ने न्यायालय को बताया कि चूंकि सभी याचिकाकर्ता सुनीता देवी तोमर व अन्य को 7वें वेतन आयोग की सिफारिशों के अनुसार वेतन व भत्ता का लाभ नहीं दिया जा सकता क्योंकि ये सभी अक्तूबर, 2018 से पहले सेवानिवृत हो गए थे।

स्कूल प्रबंधन ने न्यायालय में कहा था कि खराब वित्तीय स्थिति को देखते हुए 7वें वेतन आयोग की सिफारिश को जनवरी 2016 के बजाए, अक्तूबर 2018 से लागू किया गया।

सुनीता देवी तोमर व अन्य की ओर से अधिवक्ता अशोक अग्रवाल और कुमार उत्कर्ष ने न्यायालय में याचिका दाखिल कर कहा कि उनके मुवक्किल सेवानिवृत हो गए हैं, लेकिन स्कूल प्रबंधन ने उनको 7वें वेतन आयोग की सिफारिशों के तहत वेतन व भत्ता का लाभ नहीं दिया।

याचिका में स्कूल प्रबंधन को 7वें वेतन आयोग की सिफारिशों के तहत वेतन व भत्ता का निर्धारण करने और इसके हिसाब से बकाया रकम देने का आदेश देने की मांग की थी।

According to the 7th Pay Commission, order to give salary and allowances to the retired teachers

New Delhi | [Court Bulletin] | The High Court has ordered a private school in the capital to give salary and allowances to its retired teachers as per the recommendation of the 7th Pay Commission. The High Court ordered the school management to pay the arrears within one month to the retired teachers from January, 2016 till their retirement by fixing the salary and allowances as per the recommendation of the 7th Pay Commission.

Justice V. Kameshwar Rao has given while disposing of the petition filed by 5 retired teachers of Geeta Bal Bharati Senior Secondary School.

The court rejected outright the arguments of the school management, which said that teachers who retired before October, 2018 could not be given the benefit as it implemented the recommendation of the 7th Pay Commission from October, 2018.

The school management told the court that since all the petitioners Sunita Devi Tomar and others cannot be given the benefit of salary and allowances as per the recommendations of the 7th Pay Commission as all of them had retired before October, 2018.

The school management had told the court that in view of the poor financial condition, the recommendation of the 7th Pay Commission was implemented from October 2018 instead of January 2016.

Advocates Ashok Aggarwal and Kumar Utkarsh, appearing for Sunita Devi Tomar and others, filed a petition in the court saying that their clients have retired, but the school management did not give them the benefit of salary and allowances as per the recommendations of the 7th Pay Commission.

In the petition, there was a demand to order the school management to fix the salary and allowance under the recommendations of the 7th Pay Commission and pay the arrears accordingly.
