बिलासपुर | [कोर्ट बुलेटिन] | एक स्कूल प्रिंसिपल के परिवार के कथित सामाजिक बहिष्कार को चुनौती देने वाली याचिका पर छत्तीसगढ़ हाईकोर्ट ने महाकुल समुदाय के नेताओं को नोटिस जारी किया है। महाकुल समुदाय ने प्रिंसिपल के परिवार का बहिष्कार इस वजह से किया है, क्योंकि उनके बेटे ने दूसरी जाति की लड़की से शादी की है। याचिका में कहा गया है कि महाकुल समुदाय के नेताओं ने जशपुर जिले के पत्थलगांव में अंतरजातीय विवाह में शामिल होने वाले उनके प्रत्येक रिश्तेदारों पर 5 हजार रुपये का जुर्माना भी लगाया है।
जस्टिस गौतम भादुड़ी की सिंगल जज बेंच ने महाकुल समुदाय के नेताओं को नोटिस जारी किया है। जशपुर जिले के पत्थलगांव के विनोभा नगर निवासी स्कूल प्रिंसिपल डीपी नवलगल ने हाईकोर्ट में याचिका दायर कर आरोप लगाया है कि महाकुल समुदाय के नेताओं ने उनके बेटे के अंतरजातीय विवाह के बाद समुदाय से उनके परिवार का बहिष्कार करने का आह्वान किया है।
याचिका में कहा गया है कि समुदाय के नेताओं ने शादी में शामिल होने वाले उनके प्रत्येक रिश्तेदार पर 5-5 हजार रुपये का जुर्माना भी लगाया है। याचिकाकर्ता के वकील अब्दुल वहाब खान ने कोर्ट में कहा कि आधुनिकता के इस युग में, इस तरह का बहिष्कार एक सामाजिक बुराई और कानून के अनुसार अपराध है। इस तरह की कार्रवाई व्यक्तिगत मौलिक अधिकारों का उल्लंघन करती है।
दिसंबर 2020 में नवलगल के बेटे की शादी के बाद महाकुल समुदाय के नेताओं ने उनके परिवार के सामुदायिक कार्यक्रमों का बहिष्कार करना शुरू कर दिया। आरोप है कि उनके रिश्तेदारों से भी कहा गया कि वे उन्हें अपने किसी भी पारिवारिक समारोह में आमंत्रित ना करें। इससे दुखी होकर प्रिंसिपल ने कोर्ट का दरवाजा खटखटाया है।
Mahakul society, upset with inter-caste marriage, boycotted the family, imposed fines on relatives; High Court issued notice

The Mahakul community has boycotted the principal’s family because their son has married a girl from another caste. The petition states that the leaders of the Mahakul community have also imposed a fine of Rs 5,000 on each of their relatives participating in inter-caste marriages at Pathalgaon in Jashpur district.
A single judge bench of Justice Gautam Bhaduri has issued notices to the leaders of the Mahakul community. School principal DP Navalgal, a resident of Vinobha Nagar in Pathalgaon in Jashpur district, has filed a petition in the High Court alleging that the leaders of the Mahakul community have called upon the community to boycott his family after his son’s inter-caste marriage.
The petition states that the community leaders have also imposed a fine of Rs 5,000 each on each of their relatives attending the marriage. Petitioner’s counsel Abdul Wahab Khan submitted in the court that in this age of modernity, such boycott is a social evil and an offense as per law. Such action violates individual fundamental rights.
After the marriage of Navalgal’s son in December 2020, leaders of the Mahakul community started boycotting the community functions of his family. It is alleged that his relatives were also asked not to invite him to any of their family functions. Angered by this, the principal approached the court.
