तिरुवनंतपुरम | [कोर्ट बुलेटिन] | किसी भी व्यक्ति को अपने जन्म प्रमाण पत्र में अकेले अपनी मां का नाम शामिल करने का पूरा अधिकार है। केरल उच्च न्यायालय ने 19 जुलाई को जारी एक आदेश में यह बात कही। केरल उच्च न्यायालय ने माना है कि किसी व्यक्ति को जन्म प्रमाण पत्र, पहचान प्रमाण पत्र और अन्य दस्तावेजों में अकेले अपनी मां का नाम शामिल करने का अधिकार है।
न्यायालय ने कहा है कि अविवाहित माताओं और बलात्कार पीड़िता के बच्चे इस देश में निजता, स्वतंत्रता और गरिमा के मौलिक अधिकारों के साथ रह सकते हैं। अदालत ने इसके साथ ही एक व्यक्ति को जन्म प्रमाण पत्र, पहचान प्रमाण पत्र और अन्य दस्तावेजों में केवल अपनी मां का नाम शामिल करने की अनुमति दे दी।
हाल ही में एक व्यक्ति ने अदालत में याचिका दायर की थी। इसमें जन्म एवं मृत्यु रजिस्ट्रार, पठानमथिट्टा नगरपालिका के कार्यालय द्वारा बनाए गए जन्म रजिस्टर से अपने पिता का नाम हटाने और प्रमाण पत्र में अपनी मां का नाम शामिल करने की मांग की गई थी। याचिका उस व्यक्ति और उसकी मां ने दायर की थी।
न्यायमूर्ति पी वी कुन्हीकृष्णन ने 19 जुलाई को जारी एक आदेश में कहा कि किसी अविवाहित मां का बच्चा भी इस देश का नागरिक है और कोई भी संविधान के तहत प्रदत्त उसके किसी भी मौलिक अधिकार का उल्लंघन नहीं कर सकता।
आदेश में कहा गया, ‘‘अविवाहित माताओं के बच्चे और बलात्कार पीड़िता के बच्चे भी इस देश में निजता, स्वतंत्रता और गरिमा के मौलिक अधिकारों के साथ रह सकते हैं। कोई भी उनके जीवन में दखल नहीं दे सकता और अगर ऐसा होता है तो इस देश का संवैधानिक न्यायालय उनके मौलिक अधिकारों की रक्षा करेगा।’’
क्या है पूरा मामला?
याचिकाकर्ता की मां अविवाहित थीं। उन्होंने एक अज्ञात व्यक्ति से गर्भ धारण किया था। वह उस समय नाबालिग थीं। इसलिए पिता का नाम अलग-अलग दस्तावेजों में अलग-अलग दर्ज हुआ। याचिकाकर्ता के पिता का नाम उसके 3 दस्तावेजों में अलग-अलग था।
अदालत ने जन्म और मृत्यु रजिस्ट्रार को कार्यालय में याचिकाकर्ता के संबंध में जन्म रजिस्टर से पिता के नाम को हटाने और केवल माता के नाम के साथ एकल अभिभावक के तौर पर प्रमाणपत्र जारी करने का निर्देश दिया।
अदालत ने अपने आदेश में कहा कि वह न केवल अविवाहित मां बल्कि इस महान देश भारत की संतान है।
“हम ऐसा समाज चाहते हैं जिसमें कर्ण जैसे पात्र न हों”
अदालत ने यह भी कहा कि राज्य को उसकी पहचान और निजता का खुलासा किए बिना अन्य नागरिकों के समान उसकी रक्षा करनी चाहिए। आदेश में कहा गया, ‘‘अन्यथा, उसे अकल्पनीय मानसिक पीड़ा का सामना करना पड़ेगा।’’
न्यायमूर्ति कुन्हीकृष्णन ने कहा, ‘‘हम ऐसा समाज चाहते हैं जिसमें कर्ण जैसे पात्र न हों, जो अपने माता-पिता का पता ठिकाना नहीं जानने के लिए तिरस्कृत होने के कारण अपने जीवन को कोसता है। हमें चाहिए असली वीर कर्ण जो महाभारत का असली नायक और योद्धा था। हमारा संविधान और संवैधानिक न्यायालय उन सभी की रक्षा करेंगे और नए युग के कर्ण किसी भी अन्य नागरिक की तरह गरिमा और गर्व के साथ जी सकते हैं।’’
अदालत ने सामान्य शिक्षा विभाग, उच्च माध्यमिक परीक्षा बोर्ड, भारतीय विशिष्ट पहचान प्राधिकरण (यूआईडीएआई), आयकर विभाग, पासपोर्ट अधिकारी, भारत निर्वाचन आयोग और राज्य निर्वाचन आयोग को भी निर्देश दिया कि याचिकाकर्ता के पिता का नाम आधिकारिक रिकॉर्ड और डेटाबेस से हटा दिया जाए।

The court has said that unmarried mothers and children of rape victims can live in this country with fundamental rights to privacy, liberty and dignity. The court also allowed a person to include only his mother’s name in the birth certificate, identity proof and other documents.
Recently a person filed a petition in the court. It sought removal of his father’s name from the birth register maintained by the office of the Registrar of Births and Deaths, Pathanamthitta Municipality and inclusion of his mother’s name in the certificate. The petition was filed by the man and his mother.
In an order issued on July 19, Justice PV Kunhikrishnan said that the child of an unmarried mother is also a citizen of this country and no one can violate any of her fundamental rights guaranteed under the Constitution.
“Children of unmarried mothers and children of rape victims can also live in this country with the fundamental rights of privacy, liberty and dignity,” the order said. No one can interfere in his life and if this happens then the Constitutional Court of this country will protect his fundamental rights.
What is the whole matter?
The mother of the petitioner was unmarried. She conceived from an unknown person. She was a minor at that time. Therefore, the father’s name was recorded separately in different documents. The name of the father of the petitioner was different in his 3 documents.
The court directed the Registrar of Births and Deaths to remove the father’s name from the birth register in respect of the petitioner in the office and issue a certificate as a single parent with only the mother’s name.
The court said in its order that she is not only an unmarried mother but also a child of this great country India.
“We want a society that doesn’t have characters like Karna”
The court also said that the state should protect him like other citizens without disclosing his identity and privacy. “Otherwise, he will have to suffer unimaginable mental agony,” the order said.
Justice Kunhikrishnan said, “We want a society which does not have characters like Karna, who curses his life because of being despised for not knowing the whereabouts of his parents. We need the real Veer Karna who was the real hero and warrior of Mahabharata. Our Constitution and Constitutional Court will protect them all and the Karna of the new era can live with dignity and pride like any other citizen.”
The court also directed the General Education Department, Board of Higher Secondary Examination, Unique Identification Authority of India (UIDAI), Income Tax Department, Passport Officer, Election Commission of India and State Election Commission to delete the name of the petitioner’s father from the official records and database. .
