नई दिल्ली | [कोर्ट बुलेटिन] | एक न्यायिक अधिकारी की उस याचिका पर सुनवाई के लिए सुप्रीम कोर्ट ने शुक्रवार को सहमति दे दी जिसमें उन्होंने पटना हाईकोर्ट द्वारा उन्हें निलंबित किए जाने को चुनौती दी है। उन्होंने दावा किया कि पॉक्सो के एक मामले समेत तेजी से किए गए उनके कुछ फैसलों की वजह से उन्हें निलंबित किया गया।
बिहार के अररिया में अतिरिक्त जिला और सत्र न्यायाधीश शशिकांत राय की याचिका पर जस्टिस यूयू ललित और एसआर भट्ट की पीठ ने बिहार सरकार समेत अन्य को नोटिस जारी किया है।
न्यायाधीश शशिकांत राय ने अर्जी में कहा कि उन्हें लगता है कि उनके खिलाफ एक संस्थागत पूर्वाग्रह है, क्योंकि उन्होंने 6 साल की एक बच्ची से बलात्कार से जुड़े पॉक्सो (बच्चों को यौन अपराध से संरक्षण कानून) के एक मामले में सुनवाई एक ही दिन में पूरी कर ली थी। उन्होंने एक अन्य मामले में एक आरोपी को 4 दिन की सुनवाई में दोषी ठहराकर मौत की सजा सुनाई थी।
उन्होंने दावा किया कि ये फैसले व्यापक रूप से खबरों में छाए रहे और उन्हें सरकार तथा जनता से सराहना मिली। शीर्ष अदालत की पीठ ने याचिका पर नोटिस जारी किया और 2 हफ्ते में जवाब मांगा।
पीठ ने सुनवाई के दौरान कहा कि शीर्ष अदालत के अनेक फैसले हैं जिनमें उसने कहा है कि सजा उसी दिन (सुनवाई पूरी करके) नहीं सुनाई जानी चाहिए। हमारे हिसाब से यह न्याय का उपहास होगा कि आप उस व्यक्ति को पर्याप्त नोटिस, पर्याप्त अवसर तक नहीं दे रहे जिसे अंतत: मौत की सजा मिलने वाली है। मामले में याचिकाकर्ता की ओर से वरिष्ठ अधिवक्ता विकास सिंह पेश हुए।
Sensational claim of Bihar judge; HC suspended for giving early verdict, Supreme Court sought response from the government
New Delhi | [Court Bulletin] | The Supreme Court on Friday agreed to hear a petition filed by a judicial officer challenging the suspension of him by the Patna High Court. He claimed that he was suspended because of some of his swift decisions, including a case of POCSO.
On the petition of Additional District and Sessions Judge Shashikant Rai in Araria, Bihar, a bench of Justices UU Lalit and SR Bhatt has issued notice to the Bihar government, among others.
Judge Shashikant Rai said in the application that he felt that there was an institutional bias against him as he completed the trial in a single day in a POCSO (Protection of Children from Sexual Offenses Act) case involving the rape of a 6-year-old girl. Had done In another case, he convicted an accused in a 4-day trial and sentenced him to death.
He claimed that these decisions were widely in the news and received appreciation from the government and the public. The apex court bench issued notice on the petition and sought a reply in two weeks.
During the hearing, the bench said that there are several judgments of the apex court in which it has said that the sentence should not be pronounced on the same day (after completing the hearing). According to us it would be a travesty of justice that you are not giving enough notice, even enough opportunity to the person who is going to be sentenced to death. Senior advocate Vikas Singh appeared for the petitioner in the matter.
