जबलपुर | [कोर्ट बुलेटिन] | यातायात के सुधार के लिए संशोधित मोटर व्हीकल एक्ट 2019 मध्य प्रदेश सरकार द्वारा लागू नहीं किया गया है। ऑटो रिक्शा चालकों द्वारा नियमों का पालन नहीं करने के खिलाफ हाईकोर्ट में याचिकाएं दायर की गयी थीं। याचिकाओं की सुनवाई के दौरान हाईकोर्ट के चीफ जस्टिस रवि विजय कुमार मलिमथ तथा जस्टिस विशाल मिश्रा को याचिकाकर्ता की तरफ से बताया गया कि कार्रवाई संबंधित कागजी रिपोर्ट पेश कर न्यायालय को गुमराह किया जा रहा है। युगलपीठ ने सरकार को कार्रवाई के लिए अंतिम अवसर देते हुए अगली सुनवाई 4 सप्ताह बाद निर्धारित की है।
सतना बिल्डिंग निवासी अधिवक्ता सतीश वर्मा और नागरिक उपभोक्ता मार्गदर्शक मंच की तरफ से दायर याचिकाओं में बताया गया कि शहर की सड़कों पर चलने वाले कुछ ऑटो लोगों की जान के दुश्मन बने हुए हैं।
ऐसे ऑटो न सिर्फ शहर की यातायात व्यवस्था चौपट करते हैं, बल्कि इस हद तक सवारियों को बैठाते हैं कि हमेशा उनकी जान का खतरा बना रहता है। सवारी बैठाने के लिए ऑटो चालक बीच सड़क में कभी भी वाहन रोक देते हैं।
ऐसे ऑटो संचालन को लेकर कई बार सवाल उठे, लेकिन जिला प्रशासन अब तक उनके खिलाफ कोई ठोस कदम उठा पाने में नाकाम रहा है।
पूर्व में हुई सुनवाई के दौरान सरकार की तरफ से बताया गया था इंदौर में 10 हजार तथा भोपाल में 15 हजार ऑटो बिना परमिट संचालित हो रहे हैं। ऑटो संचालन के विनिथामक प्रावधान के तहत अधिकतम गति 40 किलोमीटर प्रतिघंटा निर्धारित की गई है।
ऑटो में व्हीकल ट्रेकिंग सिस्टम अनिवार्य होगा जो परिवहन विभाग के सेन्द्रल इंट्रीग्रेशन से लिंक होगा। इसके अलावा परमिट, क्षेत्रीय परिवहन प्राधिकारियों तथा चालकों के कर्तव्य व आचारण भी निर्धारित किए गए हैं।
प्रदेश भर में 10 साल पुराने ऑटो-डीजल ऑटो को परमिट जारी नहीं किया जाएगा। ऐसे ऑटो रिक्शा को सीएनजी में प्रतिस्थापित किया जाएगा।
याचिका की सुनवाई के दौरान पूर्व में उपस्थित हुए ट्रांसपोर्ट कमिश्नर को कोर्ट ने जमकर फटकार लगाई थी। युगलपीठ ने तल्ख शब्दों में कहा था कि पुलिस व ट्रांसपोर्ट विभाग कार्रवाई नहीं कर सकते तो न्यायालय किसी दूसरी एजेन्सी को नियुक्त कर दे। न्यायालय लापरवाही पर बरतने पर उन्हें कार्यमुक्त भी कर सकते हैं।
युगलपीठ ने ओपन कोर्ट में कहा कि अधिकारी न्यायालय के आदेशों को गंभीरता से नहीं लेते हैं इसलिए उक्त याचिका साल 2013 से लंबित है। युगलपीठ ने चेतावनी देते हुए कहा कि भविष्य में ऐसा बर्दाश्त नहीं किया जाएगा।
सरकार की तरफ से कहा गया था कि संशोधित मोटर व्हीकल एक्ट 2019 प्रदेश में 45 दिनों के अंदर लागू कर दिया जाएगा। इसके अलावा बिना परमिट चल रही ऑटो को जब्त किया जाएगा।
सोमवार को सुनवाई के दौरान सरकार तरफ से कम्प्लाइंस रिपोर्ट पेश की गई। याचिकाकर्ता ने युगलपीठ को बताया कि वोट बैंक के कारण सिर्फ दिखावे की कार्रवाई की जाती है। संशोधित नियम में भारी जुर्मान को प्रावधान है। जिससे पूरे प्रदेश के ट्रैफिक में सुधार आ सकता है।
प्रदेश सरकार द्वारा अभी तक उसे लागू नहीं किया गया। कार्रवाई के संबंध में सिर्फ कागजी रिपोर्ट पेश कर न्यायालय को गुमराह किया जा रहा है। वास्तविकता में हालात जस के तस बने हुए हैं और सड़कों में ऑटो की धमाचौकडी जारी है।
सुनवाई के बाद युगलपीठ ने उक्त आदेश जारी किए। याचिकाकर्ता सतीश वर्मा तथा अधिवक्ता आदित्य संघी ने पैरवी की।
Madhya Pradesh government did not implement the amended Motor Vehicle Act, got the last chance
Jabalpur | [Court Bulletin] | The amended Motor Vehicle Act 2019 has not been implemented by the Government of Madhya Pradesh for the improvement of traffic. Petitions were filed in the High Court against non-compliance of rules by auto rickshaw drivers. During the hearing of the petitions, Chief Justice of the High Court Ravi Vijay Kumar Malimath and Justice Vishal Mishra were told on behalf of the petitioner that the court was being misled by presenting the paper report related to the action. The bench has fixed the next hearing after 4 weeks, giving the government a last chance to act.
The petitions, filed by advocate Satish Verma, resident of Satna Building and Nagrik Consumer Guidance Manch, pointed out that some autos plying on the city roads continue to be enemies of people’s lives.
Such autos not only destroy the traffic system of the city, but also make the passengers sit to such an extent that their lives are always in danger. Auto drivers stop the vehicle at any time in the middle of the road to accommodate the ride.
Questions have been raised many times regarding such auto operations, but till now the district administration has failed to take any concrete steps against them.
During the hearing held earlier, it was told by the government that 10 thousand autos are operating in Indore and 15 thousand autos in Bhopal without permit. The maximum speed has been fixed at 40 kilometers per hour under the regulatory provision of auto operation.
Vehicle tracking system will be mandatory in autos which will be linked with the Central Integration of Transport Department. Apart from this, duties and conduct of permits, regional transport authorities and drivers have also been prescribed.
Permits will not be issued to 10-year-old auto-diesel autos across the state. Such auto rickshaws will be converted to CNG.
During the hearing of the petition, the Transport Commissioner, who was present earlier, was strongly reprimanded by the court. The couple bench had said in strong words that if the police and the transport department cannot take action, then the court should appoint some other agency. Courts can also discharge them for negligence.
The couple bench said in the open court that the authorities do not take the orders of the court seriously, so the said petition is pending since the year 2013. The couple bench warned that this would not be tolerated in future.
It was said on behalf of the government that the amended Motor Vehicle Act 2019 will be implemented in the state within 45 days. Apart from this, autos running without a permit will be confiscated.
The compliance report was presented by the government during the hearing on Monday. The petitioner told the bench that only show-off action is taken due to vote bank. The amended rule provides for heavy fines. Due to which the traffic of the whole state can be improved.
It has not yet been implemented by the state government. The court is being misled by presenting only a paper report regarding the action. In reality, the situation remains the same and there is a continuous ruckus of autos on the roads.
After the hearing, the couple bench issued the said orders. Petitioner Satish Verma and advocate Aditya Sanghi argued.
