ग्वालियर | [कोर्ट बुलेटिन] | एमपीपीएससी (मध्य प्रदेश लोक सेवा आयोग) परीक्षा 2020 में अन्य पिछड़ा वर्ग को 27 प्रतिशत आरक्षण की जगह 14 फीसदी आरक्षण देने को लेकर पुनः अंतरिम आदेश मध्य प्रदेश हाईकोर्ट ने दिया है। ग्वालियर के याचिकाकर्ता सतेंद्र सिंह भदौरिया ने हाईकोर्ट में याचिका दायर करते हुए कहा था कि उन्होंने वर्ष 2020 की पीएससी और स्टेट फॉरेस्ट सर्विस की प्रारंभिक परीक्षा दी थी।
मध्य प्रदेश लोक सेवा आयोग (पीएससी) ने प्रारंभिक परीक्षा की चयन सूची में अन्य पिछड़ा वर्ग (ओबीसी) को 27 प्रतिशत आरक्षण दिया था। जिस वजह से पीएससी में उनका चयन नहीं हो पाया। याचिकाकर्ता ने हाईकोर्ट से आग्रह किया था कि पहले भी इसके समान अन्य मामलों में अन्य पिछड़ा वर्ग (ओबीसी) को 14 प्रतिशत आरक्षण देने के अंतरिम आदेश दिए गए है। इसलिए इस मामले में उन्हें भी राहत दी जाये।
याचिकाकर्ता की याचिका सुनवाई करते हुए जस्टिस एमएस भट्टी और जस्टिस शील नागू ने कहा कि मध्यप्रदेश सरकार पीएससी की प्रारंभिक और मुख्य परीक्षा की प्रक्रिया के दौरान अन्य पिछड़ा वर्ग (ओबीसी) को 27 की जगह 14 फीसदी आरक्षण के आदेश का पालन सुनिश्चित करें।
हाईकोर्ट की डबल बेंच ने स्पष्ट कहा कि इसके पहले समान प्रकरणों में दिए गए अंतरिम आदेश की तरह ही यह अंतरिम राहत दी गई है। इस मामले की अगली सुनवाई 22 जून को नियत की गई है। हाईकोर्ट ने इस मामले को अन्य प्रकरणों के साथ संलग्न करने के निर्देश भी दिए हैं।
मध्यप्रदेश सरकार की ओर से महाधिवक्ता प्रशांत सिंह ने अंतरिम राहत का विरोध करते हुए दलील दी और कहा कि एमपीपीएससी परीक्षा की प्रक्रिया जारी है और अभी तक किसी भी उम्मीदवार को नियुक्ति नहीं दी गई है।
याचिकाकर्ता सतेंद्र सिंह भदौरिया के अधिवक्ता आदित्य संघी का कहना है कि अगले सप्ताह से पीएससी के साक्षात्कार प्रारम्भ हो रहे हैं। इस आदेश के बाद एमपीपीएससी को प्रारम्भिक और मुख्य परीक्षा के रिवाईज्ड सूची जारी करनी होगी।

Gwalior’s petitioner Satendra Singh Bhadauria, while filing a petition in the High Court, said that he had given the preliminary examination of PSC and State Forest Service for the year 2020.
The Madhya Pradesh Public Service Commission (PSC) had given 27 percent reservation to Other Backward Classes (OBCs) in the selection list of the preliminary examination. Because of which he could not get selected in PSC. The petitioner had urged the High Court that earlier also interim orders have been given to give 14 percent reservation to Other Backward Classes (OBCs) in similar cases. Therefore, they should also be given relief in this matter.
Hearing the petition of the petitioner, Justice MS Bhatti and Justice Sheel Nagu said that the Madhya Pradesh government should ensure compliance of the order of 14 percent reservation for Other Backward Classes (OBC) instead of 27 during the process of preliminary and main examination of PSC.
The Double Bench of the High Court clearly said that this interim relief has been given like the interim order given in similar cases before it. The next hearing of the matter has been fixed for June 22. The High Court has also directed to attach this matter with other cases.
Advocate General Prashant Singh, on behalf of the Madhya Pradesh government, argued against the interim relief and said that the process of MPPSC examination is going on and no candidate has been given appointment so far.
Advocate Aditya Sanghi for petitioner Satendra Singh Bhadauria says that PSC interviews are starting from next week. After this order, MPPSC will have to release the revised list of preliminary and main examination.
