नैनीताल | [कोर्ट बुलेटिन] | उत्तरकाशी में गंगा तट से 500 मीटर दायरे में मांस की दुकानें खोलने और मांस बेचने पर प्रतिबंध को हाईकोर्ट नैनीताल ने सही ठहराया है। हाईकोर्ट नैनीताल ने इसी मामले में यह भी कहा है कि जिला पंचायत और निकायों को नियम बनाने का अधिकार है। न्यायालय ने साफ किया है मामले में मटन की दुकान चलाने के लिए जिला पंचायत या जिला मजिस्ट्रेट से अनापत्ति प्रमाण पत्र प्राप्त करना अनिवार्य है।
उत्तरकाशी निवासी नावीद कुरैशी ने याचिका दायर कर कहा है कि वह हिना गांव, थाना क्षेत्र मनेरी का निवासी है। जिला पंचायत से लाइसेंस लेकर 2006 से 2015 तक किराए के मकान में मटन की दुकान चला रहा है। फिर 2016 में भूमिधरी होने की वजह से अपनी दुकान बनाकर मटन का कारोबार किया।
2016 में उत्तरकाशी जिला पंचायत के अपर मुख्य अधिकारी ने नोटिस देकर सात दिन के भीतर गंगा तट से 105 मीटर दूर होने के आधार पर दुकान स्थानांतरित करने को कहा। इस नोटिस को याचिका के माध्यम से चुनौती दी। उनका कहना था कि खाद्य सुरक्षा मानक अधिनियम 2006 के तहत उसे लाइसेंस प्राप्त है।
जिला पंचायत इसमें हस्तक्षेप नहीं कर सकती। वरिष्ठ न्यायाधीश न्यायमूर्ति संजय कुमार मिश्रा की एकलपीठ ने याचिका को खारिज करते हुए कहा कि जिला पंचायत को उप नियम बनाने का अधिकार है।

The High Court Nainital has also said in the same case that the District Panchayat and the bodies have the right to make rules. The court has made it clear that in order to run a mutton shop, it is necessary to obtain a no-objection certificate from the District Panchayat or the District Magistrate.
Naveed Qureshi, a resident of Uttarkashi, has filed a petition saying that he is a resident of Hina village, police station area Maneri. From 2006 to 2015, he was running a mutton shop in a rented house with a license from the district panchayat. Then in 2016, due to being a landowner, he did the business of mutton by making his own shop.
In 2016, the Additional Chief Officer of Uttarkashi District Panchayat gave a notice to shift the shop within seven days on the basis of being 105 meters away from the banks of the Ganges. This notice was challenged through petition. He said that it is licensed under the Food Safety Standards Act 2006.
The Zilla Panchayat cannot interfere in this. Dismissing the petition, a single bench of senior judge Justice Sanjay Kumar Mishra said that the district panchayat has the right to make bye-laws.
