नई दिल्ली | [कोर्ट बुलेटिन] | सवर्ण आरक्षण (EWS) के लिए 10 प्रतिशत आरक्षण की संवैधानिक वैधता की जांच करने को सुप्रीम कोर्ट तैयार हो गया है। सुप्रीम कोर्ट की संविधान पीठ सवर्ण, आर्थिक रूप से कमजोर वर्गों के लिए आरक्षण की संवैधानिक वैधता को चुनौती देने वाले मामले में 13 सितंबर को सुनवाई शुरू करेगी। सुप्रीम कोर्ट ने मंगलवार को कहा कि वह मुसलमानों को आरक्षण देने वाले एक स्थानीय कानून को खारिज करने संबंधी उच्च न्यायालय के फैसले के विरोध में दाखिल याचिकाओं पर बाद में सुनवाई करेगा। इससे कोर्ट सवर्ण आरक्षण में EWS के लोगों को दाखिले तथा नौकरी में 10 प्रतिशत आरक्षण देने के केन्द्र सरकार के निर्णय की संवैधानिक वैधता की जांच करेगा।
प्रधान न्यायाधीश उदय उमेश ललित, न्यायमूर्ति दिनेश महेश्वरी, न्यायमूर्ति रविंद्र भट्ट, न्यायमूर्ति बेला एम त्रिवेदी और न्यायमूर्ति जे बी पारदीवाला की पांच सदस्यीय संवैधानिक पीठ ने कहा कि वह प्रक्रियागत पहलुओं तथा अन्य ब्योरों पर छह सितंबर को निर्णय लेगी और 13 सितंबर से याचिकाओं पर सुनवाई करेगी। केन्द्र ने 103वें संविधान संशोधन अधिनियम 2019 के माध्यम से आर्थिक रूप से कमजोर वर्ग (ईडब्ल्यूएस) के लिए दाखिलों तथा लोक सेवाओं में आरक्षण का प्रावधान जोड़ा था।
शीर्ष अदालत आंध्र प्रदेश उच्च न्यायालय के आदेश को चुनौती देने वाली राज्य सरकार की याचिकाओं और अन्य याचिकाओं पर सुनवाई करेगी। आंध्र प्रदेश उच्च न्यायालय ने मुसलमानों को आरक्षण देने वाले एक स्थानीय कानून को खारिज कर दिया था। आंध्र प्रदेश उच्च न्यायालय की पांच न्यायाधीशों वाली पीठ ने चार भिन्न मतों वाले फैसले में ‘स्टेट टू मुस्लिम कम्युनिटी अधिनियम’ 2005 के तहत इन प्रावधानों को असंवैधानिक घोषित किया था
संवैधानिक पीठ ने 4 वकीलों शादान फरासत, नचिकेता जोशी, महफूज नजकी और कनू अग्रवाल को नोडल अधिवक्ता के रूप में कार्य करने के लिए कहा।
Supreme Court said on upper caste reservation we will examine its constitutional validity
New Delhi | [Court Bulletin] | The Supreme Court has agreed to examine the constitutional validity of 10 percent reservation for the upper castes (EWS). The Constitution Bench of the Supreme Court will commence hearing on September 13 in the matter challenging the constitutional validity of reservation for the upper castes, economically weaker sections. The Supreme Court on Tuesday said it would later hear the petitions against the High Court’s decision to quash a local law granting reservation to Muslims. With this, the court will examine the constitutional validity of the decision of the Central Government to give 10 percent reservation in jobs and admission to the EWS people in the upper caste reservation.
A five-judge Constitution Bench of Chief Justice Uday Umesh Lalit, Justice Dinesh Maheshwari, Justice Ravindra Bhatt, Justice Bela M Trivedi and Justice JB Pardiwala said it will decide on the procedural aspects and other details on September 6 and hear the petitions from September 13. Will do The Center had added the provision of reservation in admissions and public services for the Economically Weaker Sections (EWS) through the 103rd Constitutional Amendment Act 2019.
The top court will hear the state government’s petitions and other petitions challenging the Andhra Pradesh High Court order. The Andhra Pradesh High Court had struck down a local law giving reservation to Muslims. A five-judge bench of the Andhra Pradesh High Court, in a four-judge judgment, declared these provisions unconstitutional under the ‘State to Muslim Communities Act’ 2005.
The Constitutional Bench asked four advocates Shadan Farasat, Nachiketa Joshi, Mahfouz Najki and Kanu Agarwal to act as nodal advocates.
