बेंगलुरु | [कोर्ट बुलेटिन] | पति अपनी पत्नी से दुधारू गाय की तरह बर्ताव नहीं कर सकता है। बिना प्यार के उससे पैसे वसूलना भी क्रूरता है। कर्नाटक हाई कोर्ट ने हाल ही में उक्त बातें कही। कोर्ट ने जून 2020 में फैमिली कोर्ट की ओर से पारित आदेश के खिलाफ एक महिला की अपील पर सुनवाई करते हुए यह टिप्पणी की, जिसमें क्रूरता के आधार पर तलाक से इनकार किया गया था।

 

न्यायमूर्ति आलोक अराधे और न्यायमूर्ति जे एम खाजी की पीठ ने कहा कि वर्तमान में, भले ही पत्नी ने अपने पति के असफल बिजनेस पर 60 लाख रुपए से अधिक खर्च किए हों, लेकिन उसके साथ अच्छा व्यवहार नहीं किया गया, जिससे उसे भावनात्मक और मानसिक पीड़ा हुई।

 

कोर्ट ने क्या कहा अपने फैसले में?

 

बार एंड बेंच डॉट कॉम की रिपोर्ट के मुताबिक, हाई कोर्ट ने अपने फैसले में कहा, ‘यह साफ है कि पति ने उसके साथ एक दुधारी गाय की तरह बर्ताव किया है उसके प्रति भौतिकतावादी दृष्टिकोण रखता है। उसका साथ कोई भावनात्मक संबंध नहीं था।

 

उसके रवैये ने अपने आप में उसे मानसिक पीड़ा और भावनात्मक आधात पहुंचाया है जो मानसिक क्रूरता का आधार बनाने के लिए पर्याप्त है।’पति ने कोर्ट के सामने तर्क दिया था कि चूंकि उसके पति के परिवार पर भारी कर्ज है, इसलिए वह उसकी और उसकी बेटी की देखभाल नहीं कर सकता है।

 

यूएई में पति के लिए खोली थी सैलून

 

इसलिए उसने काम करने का फैसला किया और 2008 में संयुक्त अरब अमीरात (यूएई) में नौकरी पा ली। महिला की ओर से कोर्ट को बताया गया कि उसने यूएई में अपने पति के लिए एक सैलून की दुकान खोली थी और 2012 में एक निवेशक वीजा के तहत उसे खाड़ी देश ले जाने के लिए काफी पैसा खर्च किया था, लेकिन एक साल के भीतर ही उनके पति भारत लौट आए।

 

महसूस होने के बाद कोर्ट का दरवाजा खटखटाया

 

महिला ने कहा, उसने परिवार के सभी कर्ज चुका दिए हैं और अपनी इंकम से चिकमगलूर में कुछ जमीन भी खरीदी है। महिला ने कहा, आखिरकार उसने महसूस किया कि उसका इस्तेमाल केवल उसके पैसे के लिए किया जा रहा था, जिसके बाद उसने तलाक के लिए फैमिली कोर्ट का दरवाजा खटखटाया। फैमिली कोर्ट ने तलाक की याचिका को खारिज करते हुए एक पक्षीय आदेश जारी किया।

 Salon was opened for husband in UAE

 

So he decided to work and got a job in the United Arab Emirates (UAE) in 2008. The court was told on behalf of the woman that she had opened a salon shop for her husband in the UAE and had spent a lot of money to take him to the Gulf country under an investor visa in 2012, but within a year his Husband returned to India.

The woman said, she has repaid all the debts of the family and has also bought some land in Chikmagalur from her income. Eventually, the woman said, she realized that it was being used only for her money, following which she approached the family court for divorce. The Family Court issued an ex parte order dismissing the divorce petition.
