चेन्नई | [कोर्ट बुलेटिन] | एनआईए (राष्ट्रीय अन्वेषण अभिकरण) की जांच वाले एक मामले के आरोपी को मद्रास हाई कोर्ट ने यह शपथपत्र देकर जमानत लेने को कहा है कि वह भारत के संविधान का पालन करेगा। जस्टिस पीएन प्रकाश और जस्टिस एए नक्किरन की खंडपीठ ने माओवादियों से जुड़े एनआईए के मामले के दूसरे आरोपी सुरेश राजन को जमानत देते हुए यह शर्त रखी।
पीठ ने अपने हालिया आदेश में कहा, ‘सुरेश राजन विशेष अदालत में तमिल में एक हलफनामा देगा जिस पर उसके हस्ताक्षर और अंगूठे का निशान होगा और इसमें संविधान की शपथ लेगा कि वह माओवादी विचारधारा को नहीं मानता। वह यह भी कहेगा कि वह हिंसा में भरोसा नहीं करता और संविधान को नुकसान पहुंचाने वाला कोई काम नहीं करेगा।’
पीठ ने अन्य सामान्य शर्तें भी लगाईं और कहा कि अगर वह इनमें से किसी का भी उल्लंघन करता है तो विशेष अदालत को जमानत रद्द करने का अधिकार है।
एनआईए ने 8 जून, 2021 को मामले की जांच अपने हाथ में ली थी और सुरेश राजन को गिरफ्तार किया था। उसे न्यायिक हिरासत में भेज दिया गया था।
Chennai | [Court Bulletin] | The Madras High Court has asked an accused in a case probed by the NIA (National Investigation Agency) to take bail on an affidavit that he will abide by the Constitution of India. A division bench of Justice PN Prakash and Justice AA Nakkiran made this condition while granting bail to Suresh Rajan, another accused in the NIA case involving Maoists.
In its recent order, the bench said, “Suresh Rajan will give an affidavit in Tamil bearing his signature and thumb impression in the special court and take an oath of the Constitution that he does not believe in Maoist ideology.” He will also say that he does not believe in violence and will not do anything that is harmful to the Constitution.
The bench also imposed other general conditions and said that the special court has the power to cancel the bail if it violates any of these.
The NIA took over the investigation of the case on June 8, 2021 and arrested Suresh Rajan. He was sent to judicial custody.
