नई दिल्ली | [कोर्ट बुलेटिन] | झारखंड में पंचायत चुनाव निर्धारित समय पर और बिना ओबीसी आरक्षण के ही होंगे। चुनाव पर रोक लगाने और ओबीसी को आरक्षण देने के लिए दायर याचिका सुप्रीम कोर्ट ने बुधवार को खारिज कर दी। सुप्रीम कोर्ट के 3 जजों के बेंच ने अगले चुनाव के पूर्व ओबीसी को आरक्षण देने के लिए ट्रिपल टेस्ट की प्रक्रिया पूरी करने का निर्देश सरकार को दिया।
शीर्ष अदालत ने कहा कि झारखंड में पंचायत चुनाव की तिथि घोषित कर दी गयी है और प्रक्रिया भी शुरू है। ऐसे में यह याचिका अब अप्रासंगिक हो गयी है और अदालत इसमें हस्तक्षेप नहीं कर सकता। झारखंड में 14 मई से चार चरणों में पंचायत चुनाव होने हैं।
झारखंड में पंचायत चुनाव बिना ओबीसी के आरक्षण के कराए जाने के खिलाफ गिरिडीह के आजसू सांसद चंद्रप्रकाश चौोधरी ने सुप्रीम कोर्ट में याचिका दायर की थी। याचिका में कहा गया था कि झारखंड सरकार पिछड़ा वर्ग को आरक्षण दिए बगैर पंचायत चुनाव कराना चाहती है।
उन्होंने अदालत से आग्रह किया था कि पंचायत चुनाव से पहले ट्रिपल टेस्ट के तहत एक आयोग का गठन हो, जो पिछड़ा वर्ग का इंपीरियल डाटा इकट्ठा करे और इसी आधार पर पंचायत चुनाव में पिछड़ा वर्ग को आरक्षण मिले।
आजूस नेता ने इस मामले में महाराष्ट्र और मध्यप्रदेश का उदाहरण भी दिया था। याचिका में राज्य सरकार के साथ निर्वाचन आयोग को भी उन्होंने प्रतिवादी बनाया था।
याचिका में कहा गया था कि सुप्रीम कोर्ट के आदेश पर महाराष्ट्र व मध्यप्रदेश सरकार ने अपने-अपने राज्यों में पंचायत चुनाव कराने पर रोक लगा दी और ट्रिपल टेस्टिंग के लिए कमेटी का गठन कर दिया है।
झारखंड सरकार को भी वहां की तरह पिछड़ा वर्ग को आरक्षण देने के लिए चुनाव से पहले ट्रिपल टेस्टिंग कराने के लिए कमेटी बनानी चाहिए।
सरकार की ओर से अदालत को बताया गया कि पंचायत चुनाव में पहले ही देरी हो गयी है। ट्रिपल टेस्ट की प्रक्रिया पूरी होने में काफी समय लगेगा। इस कारण सुप्रीम कोर्ट के पूर्व के आदेश के आलोक में बिना ओबीसी को आरक्षण दिए ही चुनाव कराए जा रहे हैं।
राज्य में चुनाव की प्रक्रिया शुरू रहो गयी है। ऐसे में इस पर रोक लगाना उचित नहीं होगा। सभी पक्षों को सुनने के बाद सुप्रीम कोर्ट ने याचिका खारिज कर दी।

The Supreme Court on Wednesday dismissed the petition filed for a stay on elections and reservation for OBCs. A 3-judge bench of the Supreme Court directed the government to complete the process of triple test to give reservation to OBCs before the next elections.
The apex court said that the date of Panchayat elections in Jharkhand has been declared and the process is also on. As such, this petition has now become irrelevant and the court cannot interfere in it. Panchayat elections are to be held in Jharkhand in four phases from May 14.
AJSU MP from Giridih Chandraprakash Choudhary had filed a petition in the Supreme Court against the Panchayat elections being held without reservation for OBCs in Jharkhand. It was said in the petition that the Jharkhand government wants to conduct panchayat elections without giving reservation to the backward classes.
He had urged the court that before the Panchayat elections, a commission should be formed under the triple test, which would collect the imperial data of the backward classes and on this basis, the backward classes should get reservation in the panchayat elections.
The AJUS leader had also given the example of Maharashtra and Madhya Pradesh in this matter. In the petition, along with the State Government, he had made the Election Commission as a respondent.
It was said in the petition that on the orders of the Supreme Court, the Maharashtra and Madhya Pradesh governments have banned the conduct of panchayat elections in their respective states and have formed a committee for triple testing.
Jharkhand government should also form a committee to conduct triple testing before elections to give reservation to backward classes like there.
On behalf of the government, the court was told that the panchayat elections have already been delayed. The process of triple test will take a long time to complete. For this reason, in the light of the earlier order of the Supreme Court, elections are being conducted without giving reservation to OBCs.
The process of election has started in the state. Therefore, it would not be appropriate to ban it. After hearing all the parties, the Supreme Court dismissed the petition.
